Pistol sale to part-time Hawaii resident?
« on: March 31, 2018, 07:31:07 PM »
Would I be allowed to sell one of my personal handguns to a part-time Hawaii resident (they have a Nevada driver's license)?

The intent is that the pistol would remain in Hawaii for their use when they are here.

Thanks in advance.

If the pistol is in Hawaii then they need a pistol permit.

I know if that if they bring a firearm that they currently own from a different state, they have 5-days to get it registered with HPD.  Can I sell it to someone who does not have a Hawaii ID, but is a part-time resident here? Since I've been told that local gun shops can only sell to Hawaii residence. I'm not asking if they can own it without registering it, I'm asking if they can buy it from me, and leave the pistol in Hawaii so it's available for their use when they are here.

Hawaii does not have a residence requirement. Federal law Prohibits people buying handguns out of state. Which ever state they claim as their residence is where they would have to buy.

Another thing to note is that it’s illgeal to lend or loan a firearm to some one and it must be kept in their residence or bussiniess. This could also cause problems if they leave it here, who’s possession would it be insect.....

You seem to understand the difference between acquiring and registering a firearm.  That's good.

Simple:  Have him go get the permit from HPD.  If he can pass the permit application process, then you have nothing to worry about regarding residency.

Once the pistol is transferred, he needs to register it in HI no matter where he intends to keep it.

As stated, he needs to decide where to store it when he's gone.  A gun box only he has access to in a friend's house, or secured in a place he rents or owns year round, should be fine.

He can also have an FFL store it.  I don't know if they charge much for that.  Depending on if he's military or LE and which FFL, he might find someone willing to store it for free if it's a short period each time.  Many gun shop owners are very accommodating to their regular customers.  Make sure he buys lots of ammo, targets and gear from the store if they help him on the storage!

Mahalo! That was the information I was looking for.

A few of the local gun stores here told my friend that needed to be a local resident with a Hawaii ID in order to purchase a gun here. Good to know that's not the case.

I'm not saying it's a done deal.  I'm just saying once your friend applies for a Permit to Acquire, they'll let him know whether they need more info and whether or not he can obtain a permit.

Better to get an official ruling from HPD than debate it to death.

And share your findings here so we can learn from it or analyze it if there's a denial.

I'd like to know about this

This is true for pistols.  That's why I added the Mrs. name on the pistols.  For when I'm not home and if she has to defend herself.

HPD thought I was crazy "why you making it joint?  If you get divorced, she gets half".

Rifles/shotguns can be "loaned" to a qualified individual for 15 days in state and 75 days out of state.

I'd imagine as long as the person looking to acquire has a local address, valid identification, and safety certifications, there should be no issues.

I have an out of state ID - HPD only scrutinizes my ancient hunter ed permit.
