SCOTUS: Amy Coney Barrett - 2A Wildcard Nominee?
« on: July 09, 2018, 08:56:25 AM »
Been trying for weeks to find articles or sources that might show any past circumstance in which President Trump's alleged "heavy favorite" nominee for the SCOTUS Amy Coney Barrett is a solid constitutionalist for the Second Amendment.

Couldn't find anything.

Threads on AR15 dot com also reveals some ambiguity.

Left-leaning website "Heavy.com" also bring this up:

https://heavy.com/news/2018/07/amy-coney-barrett-gun-control-second-amendment/

Why is it so hard to know her viewpoints on guns? She hasn’t spoken publicly about her opinions on the Second Amendment. She was just confirmed as a judge on the Seventh Circuit Court of Appeals on October 31, 2017. Prior to that, she was a professor of law at the University of Notre Dame from 2002 to 2017. In her time on the 7th Circuit Court of Appeals, she’s authored eight majority opinions and one dissent. But none of those opinions concerned the Second Amendment.

The only other thing we really know so far is that Amy Coney Barrett’s husband, Jesse Barrett, is a federal prosecutor and has handled a number of cases related to guns. Jesse is an Assistant U.S. Attorney for the Northern District of Indiana. In his career, he’s handled cases involving felons who possessed firearms. But since this is part of his job, it really can’t give us an indication on his viewpoints. And of course, how Amy Coney Barrett will rule on the Second Amendment won’t have anything to do with her husband’s job.

Amy Coney Barrett, a leading contender to fill the upcoming vacancy on the U.S. Supreme Court, has argued that
justices should not be bound by court precedent in deciding whether to overturn landmark decisions that they deem
out of step with the Constitution.
Quote
“I tend to agree with those who say that a justice’s duty is to the Constitution and that it is thus more legitimate for
her to enforce her best understanding of the Constitution rather than a precedent she thinks is clearly in conflict with
it,” she wrote in 2013 in the Texas Law Review.

That could go either way for a specific issue. For 2A, if she believes past precedence was not following the Constitution in word or spirit, she won't feel bound to uphold or follow prior "unconstitutional" decisions. There are many rulings that have ruled the regulations in place do not violate the Constitution. Those could be overturned if the majority sides with her.

Remember, she's not a lone judge. She might not want to place precedence over a differing interpretation of the Constitution, but her fellow judges may just follow precedence.

Barrett doesn't have a chance to get Senate confirmation.

If she's Trump's nominee, she'll have a 100% better chance of confirmation than the others under consideration.

She is highly anti Roe V Wade.  2 R Senators alrdy said they won't vote for her and the Rs can't afford to lose a single vote.  McConnell told Trump to chose between Kethledge or Hardiman  if he wants a Senate confirmation before the mid terms.

People say what they say. They may be trying to "guide" Trump toward their preferred choice before his announcement.  But when it's time to vote, they don't want to be the vote that stopped the confirmation, especially if they are up for reelection this year.

I was listening to a discussion on the topic of the potential for long term impacts of Trump's nomination.  Key thing to remember is that the pool of judges are from past administration nomination to lower courts.  So to a certain extent, most if not all of them come sort of "pre endorsed" by many of those currently in the House and Senate.  Hopefully something that this administration is also using to shape this country.

Trump seem to appreciate the impact his administration has via this process.  He tweeted about that this morning.  It was one of the key aspects of his campaign and one that I was keenly interested in seeing how it took shape, as well as many here.

And the Pick is in ......

Brett Kavanaugh

Kavanaugh was nominated to the D.C. Appeals Court by Bush in 2003. His confirmation hearings were contentious and stalled for three years over charges of partisanship. Kavanaugh was ultimately confirmed in May 2006 after a series of negotiations between Democratic and Republican senators

Kavanugh has stated that he considers Roe v. Wade binding under stare decisis and would seek to uphold it,[23] but has also

McConnell warned Trump that Kavanaugh will probably not be confirmed before the mid terms.  It took 3 years before he got confirmed to the Circuit Court of Appeals.

So, this should be a piece of cake. He's already been vetted and confirmed at a very in-depth level.

I can't help thinking this is Trump playing chess. He's willing to sacrifice his #2 pick. When that plays out, he'll put his #1 pick up.

If the #2 is confirmed, there's the real chance Trump gets to replace Ginsberg soon.  Then his #1 pick gets their shot.

Trump wins no matter what.
