Stripped lowers, rifle pistol or other
« on: February 08, 2019, 10:34:38 AM »
I have a few lowers, one of which i want to convert to a pistol.  My question is this, on the 4473 does the dealer mark the stripped lower as a rifle, pistol, or other?  Wouldnt it have to be marked as other?  Because the stripped lower is in no specific configuration.  My thought is,  If you buy a complete ar15 rifle then yes the 4473 will state rifle, and likewise for a ar15 pistol.  Im looking to build a pistol with a lower i have, i just dont want to be in violation of any NFA laws.  And for backround info, i now live in washington, having left Hawaii mid year.

Thanks

As you said, stripped lowers are marked as "Other" on 4473s unless it is bought as a assembled rifle lower.

When the dealer completes the 4473, make sure they don't check "RIFLE".  Once submitted, the rules apply based on what type the dealer checked.

If he marked "RIFLE", you aren't allowed to legally build it as a pistol.  That would technically constitute an SBR.

Did you acquire the lowers in Hawaii? Did you use a rifle permit to acquire them?

Yes and yes.  Good point, on the permit.   I think im going to give Daniel a call and ask him directly.  Odds are, just to be safe, im going to pick up another lower.

Dealers are supposed to keep the 4473 on file for 20 years.  That's your best bet to find out.
