Surprised no body got shanked in self defense the way the mob started flipping shit at a restaurant where everyone has a knife on the table. Guess a sturdy fork would do in a pinch too. >:D

Toppling furniture isn't a direct threat to the people.  Yelling at people (short of screaming threats to inflict bodily harm) is also not a physical threat.

I imagine a few had knives under the table or napkins, ready for any threats to their personal safety.

You also have to consider the number of people in the mob compared to the number of customers and staff willing and able to put up a fight.  Customers and lower-level employees will defer to the manager, who should be calling police.

If I were in that situation, I'd let the manager deal with it -- it's their place.  Of course, I'd also ask the waiter for a steak knife for my bowl of soup.   :geekdanc:

That is true, because they would have to resolve conflicting appeals court rulings. But if the 9th circuit says the same thing as the 3rd circuit they can reject the case more readily.
