New York State Rifle & Pistol Association, Inc. v. Bruen: Supreme Court (Read 2685 times)

DocMercy

This is the evening before oral arguments on Nov. 3. 2021. NPR broadcast an interview with Jennifer Mascia  and Prof. Darrell Miller.

https://www.wbur.org/onpoint/2021/11/02/supreme-court-rifle-big-gun-case-and-what-it-means-for-u-s-gun-law

The audio recording (47:22) is lengthy and contains more information than the short transcript. The extreme libertarian interpretation of the 2nd Amendment can theoretically be stretched to:

1. Allow mental defectives to bear arms.
2. Allow blind people to bear arms.
3. Remove ban on handguns aboard an airplane.
4. Permit those accused of a crime (but not convicted, yet) to carry weapons inside a court of law.

This is what you get when you treat the right to bear arms as absolute. Scalia's claim that common sense does not give individuals the right to possess any weapon in the universe. Wrong, Antonin. The forefathers' language is logically flawed, not anticipating the expansion in the meaning and scope of arms. Let's see what Judge Thomas does with the case. Balls to the walls worship of the second amendment should allow armed citizens to bear arms at speeches of politicians and rulers. To hell with Edward III.

Such a massive overturning of laws/ policies toward guns would be extremely ballsy, yet welcomed with open arms

Watched the livestream on YouTube from lawyer/ 2A advocate @ArmedScholar where he played the court’s arguments real time. Was awesome. Even though it was like 0500 here when it started. HOWEVER, the obvious anti-gun Justices were pretty quiet except when NYSRPA argued for the case, and when the NY representatives argued, the pro-2A Justices were all over them, asking tons of questions, making them stumble, and the lady who was arguing against the case got shut down and it was obvious she had no fire or ammunition left for her side of the case. Defense against for State of NY was solid but didn’t seem to impress them. Let’s hope the Court does the right thing and helps us get our rights back and kickstart a myriad of other cases to follow allowing others states to change their laws and policies, including our state.

It would appear that NY is already making new bills to amend in anticipation of losing this case in the NY SCOTUS. So, you can have your CCW for "self defense", but you can't defend yourself in these places with a firearm. lol

It appears to me that if you drove your truck to HD you could carry, or if you went grocery shopping using your own vehicle.  Hawaii would probably say any place open to the public, including roadways.

I can't help but not be optimistic about the possibility of open or concealed carry in this communist state of hawaii.

Because it wouldn't surprise me at all that our current legislators would immediately start drafting measures to restrict  where one could actually carry open or concealed in hawaii.

It probably would be so restrictive, the only places we could carry open or concealed would be in our own homes and property or place of sojurn.

Which is essentially where we are right now, basically.

But still, I'm hoping the Supreme Court's ultimate ruling will abolish hawaii's current unconstitutional firearm laws.

Maybe HI also is getting ready too. There is a bill that requires tasers to also be carried with open carry handguns.
