Waianae Shootout
« on: March 15, 2022, 04:34:30 PM »

Quote
According to HPD Lt. Deena Thoemmes, the whole situation started three or four days prior when the Waianae homeowner’s vehicle was burglarized and a gun and cash were stolen.

That homeowner, identified by police as victim #1, did some “self-investigating” and determined who the possible suspects were, Thoemmes said.

Victim #1 eventually was able to contact the alleged car burglars and an arrangement was made to meet up Tuesday morning to negotiate an exchange of the stolen items.

According to Thoemmes, three suspects showed up to the home for the exchange around 8:30 a.m., when one of the suspects pulled a gun and shot at victim #1, grazing him in the head. Victim #1 then pulled a gun of his own and returned fire, striking and killing suspect #1, who fired the initial shot.

An employee of victim #1 -- identified as victim #2 -- arrived at the home at the time of the incident and tried to give first-aid to mortally-wounded suspect. While victim #2 was rendering aid, suspect #2 shot victim #2, causing crucial injuries.

Suspect #2 then got into a black SUV and tried to drive off when victim #1 shot and critically wounded suspect #2.

Suspect #3, who was a passenger in the SUV, took off on foot in the direction of Pokai Bay. HPD says they have not yet positively identified that person. Suspect #3 is described as being a fair-skinned man, clean cut, who was last seen wearing a T-shirt and camouflage colored pants.

Could be an important self-defense case. Victim #1 was fired at first, then returned fire.

Peter Atai lives nearby. He said he and one of the victims in the shooting had had enough after being burglarized multiple times over the last two weeks. He said they took matters into their own hands and tried to find out who had been stealing from them.
“No matter how much I tried to call the police department, their hands are tied. They can’t get there at the time that we need to capture the people who are doing this,’ Atai said.
Lt. Thoemmes said the prosecutor’s office will have to determine whether the shooting can be considered self defense.

Seems like the victim(s) and the suspect(s) were not strangers.

I get one. Committing an unauthorized investigation resulting in 2nd degree murder and aggravated assault. Since guns were involved, I am sure they going charge someone with something. They couldn't let it go, could they? After all, if the homeowner didn't investigate who stole from him, which the cops were too lazy to do, none of this would have happened. If go to trial, I like be on the jury. I guarantee at least a hung jury because I would not convict victim 1 for killing suspect 1 and wounding suspect 2.

There's no indication in the OP post saying any of the victims filed a police report regarding the initial car break-in and firearm theft.

Quote
[§134-29]  Reporting lost, stolen, or destroyed firearms; penalties.
(a)  Every person shall report the loss, theft, or destruction of a firearm
that the person owns or possesses within twenty-four hours upon the
discovery of such loss, theft, or destruction

it's a misdemeanor, but it can become the charge upon which other charges can be predicated, since his failure to report the theft directly lead to the self-investigation, which then resulted in the shootings and death. The police can't investigate if the theft goes unreported.

If the theft was reported within a day of discovery, then .... never mind.

If this all happened within 24hrs, then he should get an honorary detective badge from HPD.

The OP article said, "Honolulu police say it all stemmed from a car break-in several days ago, in which cash and a firearm were stolen."

Sounds like it happened more than a day or two after the theft.

I saw an interview on the news where stuff was stolen from them before, reported to HPD and nothing was done.  Same on the BI and that is why couple people I know who got stuff stolen didn't bother to report it. Waste of time.

That's true of all petty thefts -- robs you of precious time to report something that will likely never be recovered.

Most people who decide to file a report either know who did it, or their insurance carrier requires a copy of a police report before paying a claim.

Honolulu now has an online form for non-emergency reporting.  If people know about this, it should improve the accuracy of crime stats and help document cases that may become frequent or escalate into something worse -- like a burglary that escalated into a homicide.

Also, stellar reporting as always.  Seems like there's a LOT more to this story (always are).  But also somewhat part of the dynamics of smaller and tight knit communities.

Have "a friend" that is well known in his community and has a property where "only a fool" would break in and take stuff.  Well, there was a break in and stuff stolen a while back.  Word was sent out to return stuff since some items had sentimental value.  A couple of days later, the items were returned. . .

I had heard of those stories, but always 5-6 person versions.  Never from the person it happened to.
