I was at the food expo a few weeks ago and there was a booth that had the distributor selling these. In about 10 mins, I saw 8 units sold.  I overheard him telling people you can carry it. However, doesn't HRS134-51 come into play?

Tasers and pepper spray would be excluded because there are 2 separate laws about them and the deputy attorney general stated that tasers can be carried in public.

Then there are a few LGS selling them as well. 1 states you can carry it, the other makes no statement about carrying.

So just be careful if you or someone you know bought this and plan on carrying it.  What it would come down to is someone gets arrested for carrying this and fights it in court, which would set precedent for everyone else.

Plus there are way cheaper options if this type of device is legal to carry. UMAREX is 1 option. $440 a pop for the Byrna is steep.

I am not an attorney, but 2 attorneys I've spoken to (casually, not as a client) say HRS134-51 comes into play because 1 of them bought 1, and another person who knows the law mentioned the same.

i was wondering the same.  But the Byrna is "less then lethal".  I bet the guys downtown will make some change to the law

Click the link, it says in bold "non-lethal" , which is another issue.

If it falls into HRS134-51, I doubt there will be any change because you cannot carry it outside the home anyways.

Why I think it falls into HRS134-51:

The plastic projectile can break the skin (bodily injury)
Does HI's pepper spray law apply to powder form and tear gas (PAVA) type chemicals
1 needs a permit to sell pepper spray, do these retailers have it
Is the "projectile" also defined as a BB, which there is a separate ROH for BB/airsoft/pellet guns and still not allowed to be carried in public

Too many unanswered questions to make a statement that 1 can carry it.

I think the Byrna is a relabeled Tippman TPX, which I have had for a number of years.  I bought some hard plastic ammo for it.  It is plastic over a glass marble.  Cranking up the power to where you get only about 22 shots per CO2 cylinder, it will bury that ammo completely into surfboard foam at 20 ft. It will go through heavy cardboard at that distance too. Shooting someone in the head or face at <20 ft could be fatal.  It will certainly hurt a lot.
