Psychiatrist question
« on: November 28, 2023, 06:12:14 PM »
My friend was diagnosed with mild anxiety 3 years ago and only went to see a psychiatrist 3 times. He recently bought a gun, but since he is diagnosed he needs a doctors letter I think. His old psychiatrist isn’t taking anymore patients. Is there any psychiatrist you guys recommend to get a letter from? He needs it done pretty quick

He shouldnt need a letter anymore due to the Stanucci lawsuit that HI lost.

But, he will have to find out when he applies as hpd makes up their own rules.

"A federal judge ruled in Santucci’s favor last year, saying the state can’t deny him a gun permit because he didn’t have a significant mental illness."

i don't know what constitutes a significant mental illness.  i don't think mild anxiety rises to that level, but you never know what HPD will do.

Requiring a letter without a diagnosed mental health condition is one thing.  But having been diagnosed with something (anxiety) might be the line they are using.

I think they will want a letter, but i'm not willing to bet either way,  Only one way to find out for sure .....

you are allowed to put "no current doctor" if they truly do not have one
but it is a state/federal violation to lie on the forms, and no one here does anything illegal...

Then the new law says you must disclose all prior doctors eff 1/1/24

What constitutes "current"?

What constitutes "current"?

"Belonging to the present time."

"Now."

People often use it when they meant "recent":

"A time immediately before the present."

"New."

Just procede as is and let us know if he gets denied.  What county is it?  Santucci lawsuit should've resolved that, to be denied it has to be a disorder with potential of violence to others or damaging property
