Testimony from the AG
"The Department has grave concerns regarding the constitutionality and legality of
this bill and the potential for this bill, as written, to subject the State to litigation and to
cause the State to incur substantial monetary liability. Among other things, the
Department has concerns grounded in the Commerce Clause of article I, section 8,
clause 3, of the U.S. Constitution; the Equal Protection clauses of the Fourteenth
Amendment to the U.S. Constitution and article I, section 5, of the Hawaii Constitution;
the Takings clauses of the Fifth Amendment to the U.S. Constitution and article I,
section 20, of the Hawaii Constitution; the Due Process clauses of the Fourteenth
Amendment to the U.S. Constitution and article I, section 5, of the Hawaii Constitution;
article I, section 2 of the Hawaii Constitution; and the federal Fair Housing Act. Many of
these provisions, among other things, would require the State to satisfy onerous meansends legal analyses in litigation and potentially require the State to pay fair market value
for the taking of property to an unknown number of individuals and entities."
Sounds more like they don't want to take the time to litigate any offenders. Again, anti 2a bills, are all constitutional according to the AG.
