State vs. Wilson

This is the charge for places to keep and registration.

Wilson was on someones land trespassing on Maui and had an unregistered 22 handgun in his waistband.  He was not charged for having a CCW, but HI's places to keep law and registration.

Wilson lost. See below:

1) HI judge dismissed the charges due to Bruen. But the Attorney General (AG) didn't agree with that, so she pushed the issue.  It went to the Hawaii Supreme Court.

2) HI SC ruled with HI due to the following:

A) Bruen is wrong

B)Heller is wrong

C) You need a time machine to go back to get history and tradition.

D) In 1810, Kind Kamehameha banned the splintered paddle   weapon in name of public safety (public safety arugement is being used)

E) Hawaii State Constitution is primary over the Constitution that applies to the entire nation.

F) The "aloha spirit" supports not needing to carry a gun

G) Wilson never even tried to apply for his HI CCW back in 2017 when this took place

But to be fair, you are being objective because I never posted Wilsons full name. So I could be talking about Wilson from Cast Away.

The next stop for this case would be SCOTUS.  Maybe they'll actually take it with how far this ruling went.  If so, it'd unlock constitutional carry across the nation.  That would be some turn of events.

Tho the odds of SCOTUS taking it up is a bit slim since there hasn't been a push for constitutional carry in the courts.

You could have also been talking about Wilson from Tool Time -- Tim "The Tool Man" Taylor's neighbor.  However, it's more likely Wilson from Cast Away would have caught a favorable current and landed in Honolulu.

I’d be surprised if SCOTUS doesn’t grant cert to a Wilson appeal; since it involves federal and constitutional law. This decision by the HI SC is a colossal opprobrium to several recent SCOTUS rulings, I can’t imagine this would be left alone.

SCOTUS needs to be careful with any case they decide to take up. A weak case and a loss, even in a pro 2a court will set precedent forever.  So any 2a related case if the judges decide to hear it, has to be a solid one.

SInce WIlson used a public defender, IDK how solid his case is or what his options are to challenge.  Also SCOTUS doesn't immediately take up a case, like our legislature, they have a "season" where they decide what cases they will hear.  This season is over, so need to wait until the next one comes around.

This case is getting a good amount of national attention. Charlie Kirk posted about it.

Since the case is based on the 2a and place to keep, it would be a good case and set good precedent for SCOTUS.  The crime hes accused of doing while carrying,  tresspassing while hiking, is very minor so there won't be the outrage like Rahimi (domestic violence).

And the public defender won't matter too much.  He'll get support from the national 2A organizations if it goes to SCOTUS.
