Registering a firearm to a spouse
« on: February 07, 2024, 01:04:54 PM »
I’m transferring a 556 ar and 9mm ar to my daughter and her husband.

He just started a new job and doesn’t have much vacation, so I think the ar’s will initially be under my daughter only…..and later also under my SIL.

I assume he just has to go registration side with my daughter, their marriage certificate, drivers license, the rifle registration and his hunters education certificate to request a new rifle registration that has both their names on it?

Thanks in advance!!

i'm presuming the son-in-law has a current long gun permit?  but wouldn't the daughter have to apply for a long-gun permit, i.e. the waiting period (is it still 2 weeks)?  even as a joint-owner?  unless she already has a long gun permit.

I think it could  be something like this:
- my daughter gets hunters ed certificate
- she gets the long gun permit
- she registers the ar and ar9

He doesn’t get a permit - he is not buying a firearm
- gets hunters Ed certificate
- goes to hpd with my daughter
- they bring existing registration, hunters Ed card, marriage certificate, his license
- don’t bring ar’s
- does fbi check - rap back? - fingerprint
- pays whatever fees
- get a new registration with both their names

no need joint register a long gun. your daughter can loan it to her husband anytime for anything.

join registration would be more applicable to hand guns, due to laws.

Not true.

Say he uses it in self defense and the cops ask her if she allowed him to use it. She says no, due to the stress.

Accident at the range when he was using it. Hpd calls her and she says no cause he never told her hes going to the range.

Low chances of this happening, but it can still happen.

Safter to be joint.

Your SIL will need a Permit to Acquire to acquire the firearm from your daughter, even if it’s joint. Because the transfer is person-to-person, the firearms need to be brought in-person for the registration.

That is true.  I can't think of many good reasons to joint register a long gun.

If your daughter leaves the island for more than 15 days.  Inheritance is easier.  Registering the gun on military bases.  Hunting on military property....

My SIL got out of the Navy due to disability.  About 10yrs service

I assume he can use the military gun ranges.

If the rifles are registered only to my daughter - will it be difficult for him to use the rifles at the ranges if my daughter isn’t with him?

I also heard you have to “register” or something with the base the firearms that will be used at the ranges

On a side tangent,

If I buy a firearm on the mainland and bring it home, can I just register it?   No need to get permit.  Just bring firearm and show my affidavit.

This is what I recall in the past.  And I assume is still current practice.

I dont think physical location of the owner has any bearing on the validity of the "loan". Inheritance is always a problem honestly, you still need to show hpd death certificate and will/trust documents. Bringing the firearm through military land is a valid concern though, If thats a thing that would ever need to happen.

Side note if they purchase the firearm from an FFL they can do registration online and do not have to coordinate both of them going to HPD at the same time. Maybe theres an FFL that would do this for them, sort of like a consignment. They would still need to go in person to get their PTAs though, but they could do that seperately at least.

On a side tangent,  for people that move to Oahu with guns, do they  just register?

Similar for if I buy a firearm on the mainland and bring it home, can I just register it?   No need to get permit.

Those are considered out of state registrations, You do not have to wait 14 days, but you still fill out all the same paperwork as if you are doing a PTA and registration of the gun at the same time. You bring the firearm to hpd registration side, fill out the full packet of paperwork(check the box for out of state) and receive the registration paper same day, just takes a little longer because of the extra paperwork.
