HB2342 Effective Immediately
The governor signed into law HB2342 which
Allows the addition of a felony charge if a person carries or uses a firearm while committing a misdemeanor offense (not including HRS 134 or safe storage)
Removes the 4 year hunters education training requirement to obtain a long gun permit to acquire.  Basically hunters education no longer expires to obtain a long gun.
Removes the prohibition of carrying or transporting butterfly/switchblade knives, and other deadly or dangerous weapons (swords, brass knuckles, etc).  Open carry only, concealed carry is prohibited.  Electric guns and batons are excepted, can be carried concealed or open.

There are no exclusions for LEO in this bill.  There might be in another part of the law that grants some kind of immunity.

FYI, there's no LEO exclusion to the batons either. So, HPD has been illegally carrying batons all these years. Zero have been arrested or charged for this.

This move underscores the broader definition of "bearable arms," which encompasses more than just firearms. Recent legal actions have already forced Hawaii to legalize the ownership and carrying of tasers and batons, with ongoing lawsuits potentially extending these rights to include butterfly knives and switchblades.
The passage of this bill, despite containing some anti-gun measures, reflects a compelled evolution in the interpretation and acceptance of the Second Amendment in Hawaii. With the governor's approval pending, the bill could be enacted as soon as his signature is obtained; otherwise, it will automatically take effect on July 10. The only thing that could stop the bills is a Veto by the governor, but that's unlikely.,

The additional felony isn't automatic.  The prosecutor has to charge the person with it.  It could apply to law enforcement.

However, law enforcement can still possess firearms with a felony, under Hawaii law, as long as it's not domestic violence.

I'll bring da aloha spirit co2 launcher.  THe kind they use to chuck T-shirts at UH football games. But load with da aloha spirit instead.

Federal law does not prohibit all felons from owning firearms. Only certain felonies strip someone of their rights to a firearm at the federal level. I don't know the list offhand but I think they are things more like fraud and other crimes not associated with violence.

Federal law says if one has been convicted of “a crime punishable by imprisonment for a term exceeding one year,” they are prohibited from possessing firearms or ammunition.  [18 USC 922(g)]

As far as I can see, the lowest class of felony offense in Hawaii is Class C, which is punishable by a term of between one and five years.

Am I missing something?

I am working off of memory here so you will have to forgive me but I recall a case a few years back where the person was convicted of a federal felony that did not take away his gun rights however state law said felons can't own guns so the fight was whether the state law applied to a federal conviction even though the federal conviction didn't take away his gun rights. Have to see if I can find the details. Of course that was a while ago so maybe the law changed since then?

Could be.  I haven’t found an easy way to see the history of changes to a federal law, so hard to tell.
