SCOTUS Garland v Cargill, ATF rule on Bumpstocks
« on: June 14, 2024, 08:00:27 AM »
SCOTUS opinion, 6 to 3, that the ATF cannot ban bumpstocks.  The ATF did not have the power to change the definition of a machine gun, from the 1934 National Firearms Act, which was defined as fires more than one round per function of the trigger.  The rule change would have to go through Congress to be enacted.

This does not affect the Hawaii ban as it was not ruled on 2nd Amendment grounds.

Interesting how CNN emphasizes it was a Trump era ban and was ruled constitutional by the conservative 5th circuit court.  Don't see them emphasizing Obama era ban upheld by liberal 9th circuit court.

Interesting statement from Everytown.  I thought assault weapons are machine guns?

"—and people can easily turn assault weapons into machine guns."

They didn't mention Trump in their article.  https://www.everytown.org/press/everytown-responds-to-supreme-courts-cargill-decision-striking-down-atf-rule-prohibiting-bump-stocks/

Thanks Zippz. Holding off on that FRT order. Not sure anyone has inventory at the moment anyway.

Don't hold your breath on the legalization of bumpstocks and frts in Hawaii.  Going to be a while.  Years to a decade away.  Gotta get rulings on magazines and "assault weapons" first.

What's also important is the dissent that was written. Rifles are in common use.

Since Hawaii doesn't recognize Supreme Court rulings as authoritative, our state will ignore this ruling.

Nice.   Does this mean Hawaii can legalize binary triggers soon?
