Nobody is above the law! NY AG Indicted for Mortgage/Bank Fraud

This is the person who campaigned for AG on one promise:  To go after Donald Trump.

Now the Left is crying, "Trump is weaponizing government!"

New York Attorney General Letitia James charged
in fraud case after pressure campaign by Trump

Quote
WASHINGTON (AP) — New York Attorney General Letitia James was indicted
Thursday on mortgage fraud charges in a case that President Donald Trump
urged his Justice Department to bring after he vowed retribution on his biggest
political enemies.

James, a Democrat who infuriated Trump after his first term with a lawsuit
alleging that he built his business empire on lies about his wealth, was charged
with bank fraud and making false statements to a financial institution in connection
with a home purchase in Norfolk, Virginia, in 2020.

The top federal prosecutor for eastern Virginia, a former Trump aide, personally
presented the case to the grand jury weeks after she was thrust into the role amid
the administration’s pressure to deliver charges.

The indictment, two weeks after a separate criminal case charging former FBI
Director James Comey with lying to Congress, is the latest indication of the Trump
administration’s norm-busting determination to use the law enforcement powers of
the Justice Department to pursue the president’s political foes and public figures
who once investigated him.

Lets wait for our SMA to come back in a few days to a week and tell us how the left is correct that the DOJ is weaponized and we're all wrong.

Lets wait for our SMA to come back in a few days to a week and tell us how the left is correct that the DOJ is weaponized and we're all wrong.

This isn't the USDOJ bringing the action.  It's the US Attorney for the Eastern District of Virginia, which includes Norfolk, VA.  I believe that's where NY AG Letitia James bought her home and lied on the application.

Quote
U.S. Attorney for the Eastern District of Virginia announced today
that a federal grand jury returned an indictment charging New York State
Attorney General Letitia James with Bank Fraud under 18 U.S.C. Section
1344 and False Statements to a Financial Institution under 18 U.S.C.
Section 1014.

“No one is above the law. The charges as alleged in this case represent
intentional, criminal acts and tremendous breaches of the public’s trust,”
said U.S. Attorney Halligan. “The facts and the law in this case are clear,
and we will continue following them to ensure that justice is served.”

If convicted, Letitia James faces penalties including up to 30 years in prison
per count, up to a $1 million fine on each count, and forfeiture. Actual
sentences for federal crimes are typically less than the maximum penalties.
A federal district court judge will determine any sentence after considering
the U.S. Sentencing Guidelines and other statutory factors.

James faces one charge of bank fraud and another of making false statements
to a financial institution. The indictment alleges she misrepresented how she
used a home she bought in Norfolk in 2020 to get a more favorable mortgage.

According to the indictment, the loan "required James, as the sole borrower to
occupy and use the property as her second home, and prohibited its use as a
timesharing or other shared property arrangement."

"Despite these representations, the Peronne Property was not occupied or
used by James as a secondary residence and was instead used as a rental
investment property, renting the property to a family of (3)," the indictment says.

You can read the entire indictment document at the CBS link above. ^^^

So, while it's true US Attorneys in each district are organizationally beneath the USDOj, they each take information provided to them by an investigating agency and then decide whether to indict or not based on the evidence presented.  The evidence has already been presented to a federal grand jury, so that's a 3rd layer of review finding there's enough evidence to charge James with fraud .

I don't see how she's going to wiggle out of this one.  She absolutely lied on the application to get a lower interest rate than would have been applied to a rental property by stating it was her second home.  She also breached the contract by having a family of 3 living there, paying rent, with James enjoying the deductions associated with expense write-offs on her taxes as a rental property.

If convicted, not only can she do time in prison, but she's on the hook for the over $18K in interest she defrauded the bank out of when she lied.  On top of that, she's going to need to hire a law firm to defend her, which won't be cheap since the process will require work in NY and VA.  I imagine she'll be losing that high-paying important job of NY AG, too.

The charging document seems pretty cut and dried.  if she manages to skate, it'll be a slap in the face of every mortgage borrower who followed the law and answered truthfully on applications rather than try to game the system & not giving a single f**k about the consequences.

Trump paid all his loans back in full.  None of his lenders had a single complaint about property valuations, interest rates or anything else.  This woman kept the money that was rightfully due the bank had she been honest.

It's at least enough to constitute a felony, I hope.  i guess it'll be up to the prosecutor as to what penalty they will ask for .... up to $1M in fines and 30 yrs in prison!

Looking for retribution makes me feel a little dirty.

I'd be happy with a few wins just to restore balance to this one-sided carnival we call a justice system.

if Hillary ever gets what she deserves, then I'll know we've achieve equilibrium!

They make it sound like a dirty word, but retribution is actually required when dealing with dishonest delusional people who have repeatedly stated their intention to murder anyone who disagrees with them.

This ongoing nightmare we've been living in since Obama tried to replace Occupy Wall Street with a race war will only end once all of them get served a whole cart of just desserts.

The way things are currently heading - if history is any guide - they will end up on their backs, in open pits out in the lonely countryside, staring up at the sky with dirt in their eyes.

It happens to them just the same, every time, whether they prevail in the short run, in which case their masters line them up to be shot once the battle is won, or we prevail, and it happens because there was no other way.

The madness of totalitarianism and those who fervently seek to impose it on the world is truly incomprehensible.  It’s the reset button to barbarism, but there it is, everywhere around us now.

Political violence is always the worst possible outcome because it sets off a chain reaction.
Whatever you hoped to oppose will come back with renewed force because people are easier to recruit when motivated by the atrocities of the opposition.

The reason MAGA has been successful so far they haven't taken the bait and everything has been done legitimately while the other side piles crimes on top of crimes.

The problem we are facing right now is that Trump has a bunch of billionaires are in his ear, and he knows very well they will turn on him the second he is out of power.
It's up to us to keep enough pressure on him to make the reforms he promised while the window is still open.
He requires the assistance of the MAGA base in his negotiations, so he can point to them and say "Look...they are not satisfied. Our deal cannot continue without some major concessions."

Sorry dude - you already got political violence aimed against YOU.

The best strategy is one that wins wars without going to battle, and so far that seems to be working, as 75% of the country opposes what the Communists are and are doing, and all that need be done is enforce the law.  As they oppose it they simultaneously loose even more support as they increasingly escalate the violence.

However, if they get full control of government, they WILL absolutely use violence against you (I.e. Covid was just a tepid gab in their view - the kid gloves were still on so to speak), and then what I said above will likely happen, as it has throughout human history.

Don't worry, as an unvaccinated person who lost my rights and was threatened with internment camps I'm keenly aware of what is possible.

The point I'm trying to make is that if you're already winning then it rarely makes sense to change tactics in the middle of a fight.

Just keep the pressure on and allow the other side to make more mistakes.

Yes we both clearly agree on this  - in writing no less.

Ditto on Covid - cost us tens of thousands to oppose them.  I always tell my wife that it was the only test we’ve ever taken that truly mattered in this life.  Of that there there is no doubt.

It’s fascinating though, that defense of crime and criminals + illegal invasion of the country to bankrupt it and politically destabilize it - is the hill they’ve chosen to die on!!!!!!!

It seems to me that Trump maneuvered them there by provoking them in specific ways - like using the National Guard, etc. - correctly anticipating their reaction.

I wonder if anyone else sees it this way?  It’s super interesting.
