For those of you who are selling/sending a firearm out of state.

You can legally as a non FFL send it to a FFL in another state.

http://www.atf.gov/firearms/faq/unlicensed-persons.html#shipping-firearms-usps

Read 7 & 8.

This was confirmed byt Calling ATF and my FFL who researched it.

You MUST go thru UPS or FedEx or similar if shipping a handgun

Read and Understand the Shippers Rules and Reg.

KEEP ALL necessary Paper Work when shipping a registered Firearm out of state as paper trail.

Remember PD does NOT have De Registration Process.

I know for a fact that rifles and shotguns can be sent right back to your home.

I'm not sure about handguns.

I seem to recall that they have to go through FFL.

FAQ # 7
7. May I lawfully ship a firearm directly to an out-of-State licensee, or must I have a licensee in my State ship it to him? May the licensee return the firearm to me, even if the shipment is across State lines?

Any person may ship firearms directly to a licensee in any State, with no requirement for another licensee to ship the firearm. However, handguns are not mailable through the United States Postal Service and must be shipped via common or contract carrier.(18 U.S.C. §§ 1715). Firearms shipped to FFLs for repair or any other lawful purpose may be returned to the person from whom received without transferring the firearm through an FFL in the recipient’s State of residence. FFLs may also return a replacement firearm of the same kind and type to the person from whom received. 18 U.S.C. § 922(a)(2)(A).

I have sent and received my pistols to the Mfg through FedEx for warranty repairs with no problems no need for FFL

If I recall ffl is only needed to assist in change of ownership.  In the case of the manufacture repair as long as you send it via ups or fedex your okay.  A lot of times if you buy from a local lgs they do the for you.   I just seen SEC do this the other day I know Daniel at KGS says he'll do it for his customers as well

If you went to the mainland for say a couple months and wanted to purchase some firearms. How would it work bringing them back home after, registration wise?

copy and pasted  from HPD's website.... "There is no 14-day waiting period for Out-of-State Registration. Once the firearm arrives in the state, you have 3 calendar days (72 Hours) to register it from the date it arrived."
go wait in line and register as out of state, all they ask is what state and who did you aquire it from and then your good to go after they run the serial numbers on the firearms.

I've read that you can't buy handguns directly from the seller in any state if you're not a resident there.  The seller would have to ship it to a Hawaii FFL holder FROM an FFL in the seller's state.  Then you will be able to pick it up once you return to Hawaii and jump through all the permit hoops: permit to acquire, 14 day wait, etc.  Also, a Hawaii FFL won't accept a package from a non-FFL sender.  The Hawaii FFL holds the handgun until you produce the permit to acquire.

Long guns are different.  As long as you are old enough, per that state's law, then you can buy and possess without being a resident there.  Most mainland states don't register long guns at all.

Then, you can use a TSA-approved container to fly them home with you -- maybe paying the airline an additional "checked bag" fee as well.  That's when the Hawaii 72-hour rule for out-of-state-purchased guns kicks in.  If you don't have your long gun permit, the HPD firearms unit will be more than happy to look after your new long gun(s) for 2 weeks.

I've not done this, but that's my understanding based on reading.  I'm sure someone will correct me if I'm wrong.

Hope it helps!   :shaka:

Partial truth.  Private sales are private sales.

Partial truth.  Private sales are private sales.

From the ATF Website:

Quote
A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

You broke federal law(s).  Anyone who sells a handgun to a stranger without verifying his own legal responsibilities is negligent.  You can be charged with trafficking in guns illegally, particularly if the firearm is used in a crime, or if the buyer was ineligible to buy a handgun in his own state due to felony conviction, mental illness, drug dependency, etc.  Chances are the firearm can be traced back to you ... the most direct way being the buyer telling authorities where he bought it.

You are obligated to ask for ID from anyone you don't know in order to determine their state of residence and age.  It's merely common sense to ensure you're following the law.  It's no different than selling a car.  You have to follow state law regarding insurance, tag removal and turn-in, title transfer, and so on.  If you can figure that out, then you can figure out who to ask how about selling a firearm legally.

PRIVATE PARTY SHIPPING OF HANDGUNS.

I don't want you guys to make any FATAL mistakes.

Shipping Handgun to FFL for sale = FEDEX NEXT DAY AIR ONLY.

Shipping Handgun for REPAIR to FFL or Repair Facility = USPS (Priority or EMS) or FEDEX or UPS (Next Day)

If you tell UPS its a Handgun they may refuse to ship it.

You broke federal law(s).

NOT TRUE.
IF SOMEONE BUYS A FIREARM FROM YOU IN HAWAII AND PRESENTS A PERMIT TO ACQUIRE, YOU'VE DONE YOUR PART TO ENSURE THAT A LEGAL TRANSACTION HAS TAKEN PLACE. WHO GIVES A SHIT WHAT HE DOES WITH THE FIREARM AFTER YOU'VE LEGALLY SOLD IT TO HIM.
HE COULD TAKE IT TO ANOTHER STATE OR ANOTHER PLANET IF HE'D LIKE.

The question asked was:
Quote

Where is the part about the buyer having a permit in the question??  I took this as a general question, not as a Hawaii-specific situation.  In many states, no permit is needed for in-state, private transfers.  Hence, the need to check ID for age and residency.
