I applied for a handgun permit (after owning several) hpd calls me n says I need to go get clearance from doc. I asked why they said my doc jus needs to clear me. I go to my doc n he asks if I have guns I said yes n he said this is like the 6th one that he was sent for no reason so he jus filled it out and sent me on my way.

Boy if this happen to me I'd already be talking to a lawyer.  I'm wondering if there's something this doctor could do with this form which may cause you to lose your current firearms?  I doubt it, but I don't know. that's why I be talking to lawyer already.

Sounds like a lawsuit waiting to happen if you ask me, or maybe there just picking random names. But it's funny that it's for existing gun owners and not new registrations.

At the doctors now. Read the letter from HPD. It says nothing about requiring an eval. The nurse stated its an internal policy. I informed them that how is it possible for them do require an appt for a psychological release for a doctor that has no background in psychology. She could not answer my question. She referred me to the manager. So I'm still waiting.
If indeed there is an "internal policy" (which I doubt...) ask them to produce it.

Remind them that physicians have immunity from issues arising out of these evaluations, and that failing to respond to one means that the process for the PTA continues.

Looks like queens is taking a anti-2a stance. It's a administrative policy that's requiring doctors to speak with their patients about their mental health. The doctors themselves don't know why they are doing it. What cracks me up is that these doctors don't have a background in mental health so what are they using as a diagnosis baseline. He just asked me if I had road rage issues, owned a guns safe, and felt depressed. I guess we can thank the aurora shooting and sandy hook for this.

I've done lots of permits in Hilo, and no one has ever asked who my doctor was.  There's a medical records release form, but all you do is print your name and SS#, then sign it.

This is the first time Ive ever had to speak with someone. This is like the third permit this year.

Operating on the theory that bureacratic inertia and dumb luck  are nature's primary forces,  we can conjecture that someone at HPD sent a request for information to Queen's and that someone at Queen's looked up your records and the result is that the pediatrician you saw just once wound up with that request and decided he need to know you better in order to fil out the form.

Maybe you already did this, but why couldn't you call your PCP, explain to his receptionist what has happened, and ask them to  hold of the pediatrician and
take over the request for information? This is assuming your PCP is cool and has done this for you before.

The pediatrician would be more likely to turn the matter over to another doctor's office than to a civilian. (The rule of: "If you ain't one of us, you must be the enemy.")
+1 seeing that u renewed your permit with your pcp before you should have no problem

I wonder if this delays the process
BC my work is very difficult to take off to go to hpd
I already bought a gun but have to wait 2 months to pick it up bc of my work schedule
Now if I also have to go to doctor that's a real big inconvenience

I find it funny how when you are sick and need to see the Dr. they really don't have time for you.  But apparently if they need to approve you for a permit they need to see you right away!   :wtf:

HRS 134-2 does not require a physicians clearance, read it here: http://www.capitol.hawaii.gov/hrscurrent/Vol03_Ch0121-0200D/HRS0134/HRS_0134-0002.htm

I would sure like to know what grounds the medical facility or HPD is using to justify these requirements. Also in HRS 134-2 its states that all forms shall be uniformed and approved by the Attorney General, it appears that only Oahu is requiring you to provide doctors information.

This topic came to mind when I visited my doc today, so I asked about the form and how many he's received in the 12+ years as my doctor? He explained that physicians receive is a generic form that asks: "If  there is a diagnosed mental health condition...Complete and return." There's no clearance involved and no psychiatric/psychological evaluation required. It's based solely on what they have on record and if there's no problem, they don't return anything. Pretty simple. As for the forms received for me? He said "I'm not your therapist, but I know you...no problems...probably shredded it."

So clearly Dblnaknak's problem is with Queen's and/or the doctor not HPD or HRS. If it is some internal hospital policy, there's little anyone can do and there's nothing to sue over. Just remember that medical facilities are like any other business. If we don't like it, we're free to shop around.

did you have to get a note from another doctor to get your permit to acquire?
or were you good to go and its just scare tactics?

bc i just went to HPD last week to start the handgun process
i also am a kaiser member and saw the letter about firearms permits, and doesn't look good for us kaiser members as gun enthusiasts
hate to say it, but kaiser looking like 2A haters.
i'm just wondering if you really have to go to another doctor, or if HPD doesn't hear anything from your doctor you are still good to go.
bc if they just give me a "no comment", they are not denying me, so why is it my obligation to find another doctor?
and if i do, how am i supposed to schedule an appointment within the 14 day waiting period?  thats pretty ridiculous.

I am a Kaiser member.  When I applied there was a printed form with the Kaiser info which I had to sign.  Waited the 14 days and picked up my handgun permit.
