I know its illegal!!! but does special people with special privileges get to own SBR's?

Im just curious because I've witness someone with an sbr register their rifle the other day at HPD and got approved and okayed! He stated and showed that he has proper documents for his sbr.

He's rich, in Hawaii that means you can do whatever you want. Right?

Right!!!

There are certain groups of people who are exempt from normal rules and regulations

The really rich,
The people who "know someone",
And criminals

as for the rest of us law abiding citizens...
We're too stupid and need these rules to keep us safe.

Wassup braddah KK, That kid barely looked18! maybe his parents maybe? or Is there a giant loophole into the Sbr world! I was reading through my revised statute book for hawaii and it sounded like SBR Is legal but theres no where to use it! unless you have you're own personal shooting range....

How you figure?

Argh.

I knew that friends and family of Very Important People (including criminals) got special privileges that us mortals can't be trusted with... all that I heard of was still relatively legal - CCW permits.  Kinda irritating to hear someone registered something that shouldn't be legal even for the police chief's buddies.

I'm no lawyer, but I don't recall seeing and exception for off duty LEO's having SBR's and if the SBR belonged to the department it wouldn't need to be registered the same way as civilian weapons. :-/

There isn't an exception for non-resident Military, is there? That would still be a bit unfair but would at least make some sense.

edit: simulposting. Or.... HPD incompetence. That would also make some sense.

^^^^^

Doesn't that get into NFA territory, anyway? Constructive intent?

Which isn't HPD's business, anyway, I suppose.

I don't know if Hawaii has there own definition of sbr but I think the federal definition and info basically says you need nfa (its an sbr) if it has a rifled barrel under 16" or, even if barrels longer than 16" if the overall length is under 26" that also makes it sbr. Also, if it has a folding stock or "easily detachable stock" the fed/batfe measures the overall length with the stock unfolded/attached. However, I think California and maybe Michigan define a less than 26" sbr as measured with the stock folded/detached.  So unless this guy had a huge unfolded stock on that 11.5" upper (I know....just wondering) making it overall over 26", then how'd he do it?

don't SBRs need a federal tax stamp?
If HPD did approve it, it may not be legal according to Federal law? An attorney needs to chime in.
