Recourse if permit takes over 20 days?

I am on day 19 waiting for two pistol permits which I applied for Jan 24th . They were supposed to call when it is ready so I have not called them as it is still within their window of 20 days but tomorrow I will be calling HPD. By law they must issue my permit or deny it within 20 days, So if they give me some BS about it what recourse is there? As much as I would love to take it to court just to stick it to this state I do not have those kind of resources or time. Anyone have this problem yet?

I would like to have some idea what I can do immediately if they do not have it ready. I will not stand for my rights being trampled on.

They were supposed to call you ??? I've never been called to pick up a handgun permit. The have the first day and he last day you can pick up your permit after the two week waiting period posted on the window for the day you apply. I usually go on the first or second day and it's always been ready for pick up.

I've filed for numerous permits.  Never once have they called, or offered to call, to tell me it was ready.  I would be willing to bet that your permit was ready on day 14 and you've now missed the window for picking it up.  Time to start over  :(

well I am talking Kona HPD, they made sure to get my phone number right so they could call, and told me it would be between 15-20 days. The other woman who deals with the firearms stuff was calling people in the background to let them know their permit was ready while I was there.

Well quick update, today was the 20th day, I called them first thing and they said it was approved but they did not have it yet because it has to come from hilo to kona and maybe it would come today, maybe tomorrow. At which time I pointed out to the woman that by law I must either have the permit issued by the 20th day or denied and that if I did not have it today it was going to be a problem. She also told me sometimes it takes longer than 20 days if they have to do additional background checks..etc.. I see no provisions for this in the law so clearly people are not keeping on top of this... She told me the days mail had not come yet and if and when it comes she would call me to say it was ready... The law actually reads "no permit shall be issued to an applicant earlier than fourteen calendar days after the date of the application; provided that a permit shall be issued or the application denied before the twentieth day from the date of application."

I did get a call a few hours later to come pick it up. When I went to pick up my guns from the dealer he noticed it had my name on the side of the sheets and mentioned something about it. I am guessing it did not come from hilo today and they went ahead and printed them out at the kona office so I could get them today.

Moral of the story. Happy I finally got the stupid permits. Not happy I had to wait so long. The firearms clerks at the Kona PD are always pleasant and courteous, not their fault I know but I think folks on the Big Island need to keep an eye on this. If I have to abide by these stupid laws they sure as hell are going to as well.

If today's Peruta decision stands, it will be a fundamental alteration of everything firearms Hawaii currently knows. imo

I certainly hope so. I will be long gone out of this state by the time a positive decision is made if any but for those poor souls left here hopefully legally carrying a firearm will become a reality. One of the handguns I purchased was a ruger LCP which will be one of my carry guns, when the subject came up of what I would do with such a small handgun at the dealer and PD I said I was going to carry it... Usually followed by a strange silence until I follow up with.. "well, not here.. obviously."
