Number 1: This is not a murder. but a case of self defense.

Number 2: Those guys were punks.

i still question the prosecutor's decision to not include manslaughter
it gives the jury an "out" between murder and hung jury/innocent

I question the prosecutor's decision to try the case in the first place, not to mention RE-trying it!

After a hung jury, are they so sure this particular defendant is guilty of murder?  They think we should go through the expense and pain of a second trial?

To me, it's just poor judgement all through the prosecutor's office.  So, if they fail to give the jury an automatic fallback verdict below the murder charge, why is that so surprising?
