Selling a gun to person on the mainland
« on: September 08, 2016, 11:19:29 AM »
I want to sell a pistol to someone on the mainland and need some help.

Is there any Hawaii permitting requirements/waiting period required?
Do I just notify HPD that the gun was transferred and sold?
What is the cheapest courier and method of mailing the gun to their FFL?

There is no requirement you notify HPD you transferred a firearm out of state, just like there is no requirement you let them know you are moving out of state.

Even if you tell them, they will keep your application and registration on file as the last known owner.  There is no "un-registration" process for firearms that are no longer instate.

All you really need for record-keeping is get the personal identification of the buyer (name, address, etc.) and proof you mailed it to an FFL.  Keep all that in your records in case HPD or the FBI come calling.

Good point, thanks.  I remember when I went in for an HPD job interview they asked me if I still had each firearm, and who I transferred them to.  I'm not sure if HPD keeps a log of that or somehow annotates it somewhere.

They don't do out-of-state departing firearms well at HPD.

I transferred a G26 to my daughter.  A year later she left the state.  About 8 months later, she bought a new pistol and sent the G26 back to me via FFL.  When I took it in for the permit AND AGAIN when I registered it, the HPD officers were really confused that my daughter would send it to an FFL when she was on a Hawaii registration as the owner.

If they had a requirement or process for showing she left the state, they would have been less confused.  The gun going from me to her, her to an FFL, and FFL to me was more than they could wrap their heads around -- TWICE!

It maybe cheaper if you had a local FFL send it to the mainland FFL.

As FFL's can use standard USPS to mail handguns.

UPS/Fedex can change up to $75 to ship your handgun vs FFL's USPS with Flat Rate box at $16.

Then tack on the FFL fees at both  ends, minimally say $25 X 2 = $50 + $16 USPS = $66 total.

FFL to FFL does offer the convenience of a person being available to sign for the package if you can't and hold it until you pick it up at a convenient time.

Only paying for one FFL, buyer end pays his FFL to pickup

True.  Either you can add to the total cost buyer pays or buyer pays  FFL directly on his end.

Sometimes the Hawaii FFL will waive the fee since it's going out of state and they don't have to jump through the HPD hoops!  Depends on the relationship you have with that store/person.

Yup.  Confirm use of USPS to send handguns from FFL to FFL.  Was the cheapest and easiest route for when I sent my HK back for some warranty work.

I've looked into selling and buying guns from friends on the mainland.  Even at "friend prices", the handful of times that I looked seriously into it, it ended up being not worth it.  Ended up being better to have a LGS bring something in new.  At least in my case.

I've thought about either buying or selling while traveling, but never ended up following through.

The FFL files this at his local Posst Office, accompanied by his paper FFL .

432.23 Manufacturers, Dealers, and Importers

Handguns may also be mailed between licensed manufacturers of firearms, licensed dealers of firearms, and licensed importers of firearms in customary trade shipments, or for repairing or replacing parts.

What's the process for an FFL03 selling to another FFL03? Can FFL03 holders use USPS and can FFL03 holders send directly to another FFL03 holder?

The way to do it is to take it to a local FFL/gun store and have them mail it to the receiving party's FFL.
Pay a transfer fee if they charge you and you're done.
The gun will be transferred to the new party by the receiving FFL.

For pistols, they can. (As well as long guns)

As a private party you can use USPS for rifles and shotguns but not pistols.

Apparently  that's an issue with the USPS form you sign.  Form 1508 says the recipient must be a "licensed manufacturer or dealer".  FFL03 holders are collectors, not dealers.  Gotcha!!   :shake:
