In my non lawyer opinion, since supressors are specifically outlawed in the State of Hawaii, this is NOT legal in Hawaii.  The actual firearm, black powder front loader is GTG, but the supressor is NOT.

So here's a question... if the feds don't require a tax stamp for this device. Is the state law written to mirror the fed guidelines? What's missing for the feds to not require a tax stamp? Hence this could be the determination on legality

What's missing for the feds to not require a tax stamp?
1.  Muzzleloaders aren't considered a firearm.
2.  Suppressor cannot be detached to be used with rifles and pistols.

It's related to how air rifles can have built in suppressors.

Hence this could be the determination on legality

Sure. If you gonna sue one, you might as well sue everyone and let them get their own lawyer.

Silencerco says it's legal in Hawaii. I purchase the rifle and I get arrested with a class C felony for possessing a "silencer". I have therefore been emotionally and financially damaged and require restitution from those who assured me it's legal in Hawaii. 'Merica!

AFAIK, it's a firearm because the operating force is an explosive but is not required to be registered because it fires loose black powder. I agree that an air rifle is not a firearm and can have a permanent silencer but is not the same.

All of this is speculation because until someone decides to push the envelope, we don't know how HPD is going to react and which law(s) they will decide to interpret any way they wish.

And after they interpret one of the laws in some whacko way that makes no sense, they will tell you ignorance of the law is no excuse.  :wacko: :wacko: :wacko:

This begs the question, what do the HAWAII STATE laws say about this gun. It might be legal per any and all state laws making it 50 state legal. But not legal per the local laws. Truth in advertising?  :crazy: :crazy: :crazy:

It's legal in all 50 under federal law. Hawaii and California say black powder = firearm = illegal
