Number one they didn't arrest him.  They weren't up to the task at that time.
I have seen many police chases called off.
They knew where the guy lived and they could get him tomorrow
rather than escalate.
They could have called for a dog, if they felt he was still dangerous.
They already knew he lived a short distance away.
This all sounds like "Monday morning Quarterbacking"
but when the guy is unarmed, drunk, and running away,
my first instinct is not to shoot him in the back.

This is not a war.  Yet.

Normally they cuff the suspect before doing a full pat down.  They didn't know for sure that he was unarmed.

There was video recently released of a Cop stopping a car for a suspected DUI.  The suspect resisted arrest and grabbed the tazer from the Cop.

After incapacitating the officer with the tazer, he retrieved a firearm from his vehicle and killed the Cop.  He then drove away.

The drunk at Wendy's was reported to have been on parole after being convicted of child abuse.  Just being arrested for DUI -- even if he wasn't convicted -- would have been grounds for revoking his parole.  This is probably what was going through his intoxicated mind when he decided to resist arrest.

Apparently the "kicking him after being shot" report was from a still frame capture where the Cop's leg was bent as he stepped over the man on the ground.  No post of the actual video where he supposedly kicked him.  So, it's more likely he was trying to not step on the man or trip himself as he raised his leg to step over him.  More fake news and lies to manipulate the narrative.

Yes, they could just stop chasing him but then there is a strong chance he could get away with the DUI. Part of a DUI case is taking a guy to the station where he blows on the machine. If that doesn't get done then he probably gets away with a DUI.
