The above articles does not spell out any of these plans, but there is a link to one document sitting in the Brennan Center's web site. This paragraph in the article may be of concern to gun owners:

"Underscoring how little lawmakers and the public can infer, another file, from the summer of 2008, mentioned that Justice Department lawyers were revising an unidentified draft order in light of a recent Supreme Court opinion. The memo does not specify the ruling, but the court had just issued landmark decisions on topics that could relate to government actions in an emergency — one about gun rights in the United States and another about the rights of Guantánamo detainees to court hearings."

When/if martial law is declared, will the government seize weapons or ammo from civilian owners? Both the HPD database and the ATF records could be scanned to determine who owns what. I doubt that any weapons taken during an emergency will ever be returned to the owners. One problem with the second amendment is the phrase, well-regulated militia, in the sentence, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” Who decides what is well-regulated as opposed to citizen-formed?

This was an issue during Katrina. Some police and NG members went to confiscate guns from legal owners there.  So after that we passed a law that your guns cannot be confiscated during a emergency or disaster.

"   §134-7.2  Prohibition against seizure of firearms or ammunition during emergency or disaster; suspension of permit or license.  (a)  Notwithstanding any provision of chapter 127A or any other law to the contrary, no person or government entity shall seize or confiscate, under any emergency or disaster relief powers or functions conferred, or during any emergency period, as defined in section 127A-2, or during any time of national emergency or crisis, as defined in section 134-34, any firearm or ammunition from any individual who is lawfully permitted to carry or possess the firearm or ammunition under part I of this chapter and who carries, possesses, or uses the firearm or ammunition in a lawful manner and in accordance with the criminal laws of this State."

This was probably the last pro 2a law signed that wasn't forced by a court case or included with a bunch of BS. 

Now this is state law, what the feds/military (Non-national guard) will do is another issue.  I'm sure HPD will willingly hand over all reg records to any one who ask during an emergency.  Which is why so many are against registration. It only serves 1 purpose, CONFISCATION.

In extreme cases where there is martial law declared, will the feds confiscate?  Most likely.  And yes, I'm sure HPD will jump heads over heels to cooperate with their registration information.

Then there are the thousands and thousands of firearms that were purchased legally prior to 1993 or 1995 that are not mandatory to be registered.  I'm sure many if not all of these owners said "screw that" to registration.

And I'm proud of those National Guardsmen who refused to cooperate with the confiscation of firearms during the Katrina disaster.
