HRA CCW Lawsuit Update
« on: November 07, 2022, 11:30:29 AM »
So this was filed in 2019 from parties such as HRA and X-ring owner (Kitiya), et al...

The state responded and ask to dismiss recently and they are correct.

1) The AG cannot be sued for denying CCW permits or making CCW (HRS134-9) law.  It's the chief who denies the permits and our legislature who made the law.  Example Young vs. Hawaii isn't Young vs. Attorney General.

2) Likewise they named the City & County of Honolulu and not the State of Hawaii. HRS134-9 (CCW law) is state law and not county ordinance.

3) Bruen made their  argument moot because "exceptional circumstance" has been removed per the AG's letter to HPD.

This was poorly written back in 2019 and holds the same as of today, despite Bruen.  Basically, they sued the wrong people.
