I like to thank the gentlemen who helped out this morning when my wife and I got rear ended by some asshole texting when I was stopped waiting to make the left turn into the range. These two guys were on it directing traffic etc. much mahalos.

I signal , pump my brakes and drive like a snail soon after passing the second bend after Haunauma Bay. Its helps by not getting rear ended, but cause traffic to be backed up behind me.
 BTW I'm already driveing at max speed of 25 mph already.

Thanks guys. We are both okay. Can't say the same for my wife's truck though. Brand new paid cash. The jerkoff driver driver most likely is underinsured and we will get screwed some way or another.

Well the minimum requirement by law is $10k liability and judging by the driver and the pos he was driving at best he has that coverage. I'm doubtfull that $10k will be enough cause our airbag sensors went off. I mean my insurance will cover if anything but that means my premium goes up. On top of that I will have a major collision on my brand new truck so the value of the truck even when repaired will be considerably less.

Sucks all over.

I have done a civil suit to recover the loses. it takes time and several trips to the courthouse but most people just say the hell with it and take the loss,

With a win in civil suit his paycheck and goverment  refunds are garnished. pretty sure most states , small claims are $5000.

with any suit all fees are paid by the loser. including your attorney fees and court cost.

It's too much bs to claim anything.  I had a sure case and the jackasses wormed their way out.  I also got rear ended by a tow truck with no insurance. I tried to take them to court and got stopped. Big time.  Not worth dying over a bumper.

I'm going to court this Wednesday for a small claims case.  I'm suing the gal who totaled my PARKED truck.  She was cited and fined in court a couple months after the crash for being uninsured.  In the meantime, my insurer paid the loss from my policy's collision coverage. 

I had a $500 deductible, and the loss was over $11K.  It's been almost a year, and the insurer sent me a letter saying their lawyers haven't been able to recover a penny.  I have 2 years from the accident to file in small claims for my deductible. 

The good news is, she eventually went to the post office and signed for the notice to appear I mailer her.  That means I have evidence she was served, and the judge has the option to issue a judgement without her presence.  At least I won't be wasting a morning showing up just to request a continuance!

Best advice I can give anyone is to call the Cops ESPECIALLY if the other person says not to!!  If they offer to take care of it without going through insurance, tell them that's fine (if you want to), but still call the police.  Without a report, the other person can change their story and there's nothing other than your word to dispute it unless you have a witness.  Even if you call the Cops, you aren't required to call your insurance companies.

I've seen this happen twice.  At the scene, they are all like "trust me!"  The next day it's all, "I didn't hit you!  YOU hit ME!"


I had one lady hit my truck's front bumper.  She was making a right on red turn while I had the left-turn green arrow.  I hit the horn, hit the left hand median to avoid her,  but she didn't even slow down!  The next day, the husband swore to his insurance agent it was part my fault because I turned into the far lane instead of the left lane of the street I turned onto.  He might have had a chance to only pay 50% of my damages, but the agent took pictures of the intersection and proved he lied (there are no lane markings, so it's only one lane).  At the scene, there was never a dispute that she turned on a red signal.  That's what the police report is good for!   Without the on-the-spot admission, they could have lied and said I was trying to run a red signal to make my left!  :D

Couple of places around here I'm careful about hand-signaling "stop" and my turn direction well before the slowdown, then I, too, pump my brakes.  I do that backing out of parking lot spaces, too.  The brake-pumping, that is.

Trouble is, fewer and fewer ditzheads recognize hand signals any more.  Other ditzheads don't see them anyhow because they're texting.

Driving is a 110% job.
I do believe that the radical and crazy notion that the Founders meant what they said, is gradually soaking through the judicial system.

The other gentleman was LIFE instructor (and former LEO) William Folk....glad you you guys are OK

I have to laugh.  Going on nine years living here now, and the "I'm cool" manner of driving with the arm dangling out the window still fakes me out sometimes.  Have to do a double take to make sure the stoner is not signalling some sort of turn.  Have to say that appears to be an Oahu thing, not seen much on BI.
