Carrying for retired LEOs?
« on: January 04, 2010, 01:41:03 PM »
Are retired LEOs allowed to carry legally in the State of Hawaii?

Here is what I could find in federal law: http://www.aele.org/fletc218.html

And in HRS 134-11, there doesn't seem to be any exemption for retired LEOs: http://www.capitol.hawaii.gov/hrscurrent/Vol03_Ch0121-0200D/HRS0134/HRS_0134-0011.htm

Someone more familiar with the LEOA act may have more info, but here is what I understand of the Federal law and Hawaii's interpretation and implementation of the necessary requirements for Hawaii retired LEOs.

As a retired LEO from another state, if you have the picture ID and the certification that said individual has met that states requirements for active law enforcement personnel. With those items, a retired LEO may essentially carry concealed in any state.

Until recently, Hawaii did not have the procedure to issue the certification necessay to confirm the training standards. As I understand it, the AG was the office responsible for the foot dragging on setting up the process. Now, the process can be found on the web.

Here is info for out of state retired LEO http://hawaii.gov/ag/LEO/Guidelines%20QRLEO.pdf

And here is the process for Hawaii's retired LEOs http://hawaii.gov/ag/LEO/

And the application http://hawaii.gov/ag/LEO/271181-1-applic-soh-firearm-certif.pdf

Note that the requisite training is only offered on the Big Island and that the cost for the training is $500.00 each year....

Ouch, that is steep.

I wonder if that would be the recommended course of training for regular CCers as well.

500 dollars  each year??  Who would want to carry with that price?

Possibly, but with the recent Heller decision, and the hopefully positive ruling on McDonald, I think it would easily be argued that such a steep price would unduley restrict a constitutional right. An analogy would be paying the same sum to vote or be able to exercise your First Amendment rights. Said economic emcumbrances to the exercise of Constitutional rights have already been ruled unconstitutional....
