In Texas, sexual assault laws include:
"For purposes of Texas sexual assault law, a "child" is a person younger than 17 years of age."
Potential defense against sexual assault against a minor:
"The defendant was no more than three years older than the child at the time of the offense,
and the child was 14 years of age or older
and the child was not prohibited from marrying the defendant."
Cody is 30, so I think the 3 year "spread" is a problem for him.
If she can't provide a driver's license as proof of age, she's probably too young to drive -- and consent to having sex.
