I hope I can make it next time they have a hearing. Came down with the flu this week.

Last time I had the chance to testify they made the hearing not open to public testimony which sucked.
Bio warfare. Come with the flu and everyone gets sick. No one can testify next hearing cause all sick. Bill passes.

Question on HB2922/SB2848 Electric Guns

I'm getting the part where the licensee (seller) has lots of requirements. Where, other than the "informational briefing" are the requirements to obtain a permit, get background checks, etc.? I may not be seeing the forest through the trees so help me out.

The bill makes many requirements that both the seller and purchaser has to complete.  There is a 2nd taser bill that has no requirements.  By having requirements, you won't be able to purchase a Taser/Stun from Amazon.

And we've seen when HI makes requirements, they find a reason that people to not meet said requirements (CCW example "exceptional circumstance").

The tough seller requirements put a lot of burden on the stores to the point they may not sell it.  The bill basically treats electric guns like firearms, almost like a State of Hawaii FFL license and regulations to sell them.  It's also "may issue" to get a store license.  Even if a business meets all the requirements to sell electric guns, it's up to the authority to issue the license or not.  Where have we seen that before?  The sellers also have to take a electric gun course that goes over Hawaii laws, offered by the county or approved by the county.  Odds are the counties aren't going to give it.  And are they going to approve courses and which ones?  Businesses will likely have to fly to the mainland to attend the training and have to convince the instructors to go over Hawaii laws.

For the user, there is a ban on other people possessing your electric gun.  If you are involved in a home invasion, your spouse cannot use your Taser.  Also no private sales without a sellers license so you cannot sell your used electric gun.  There's the whole general mental disability prohibition, kinda sounds like we'll have problems like with the permit to acquire firearms.  Can't possess one if you're under a TRO. and there's a bunch more.

All this for something you can buy in almost all states through Amazon.

Seems like they will be treating them like MACE per ROH 41-37.3. But if we DO NOT live in incorporated Honolulu, does this apply? And would it apply to the EG legislation? I can't find any state legislation on it, but that doesn't mean there isn't one

Sec. 41-37.3 Restrictions on possession, sale, and use of pepper sprays.
(a) It is unlawful for any person to use any pepper spray for any purpose except:
(1) Self-defense;
(2) Defense of another person; or
(3) Protection of property of the person or of another person.
(b) It is unlawful for any person to sell or offer for sale any pepper spray in the city without a license
obtained pursuant to Section 41-37.4.
(c) It is unlawful for any person to sell, offer for sale or otherwise furnish any pepper spray to a minor in
the city.
(d) It is unlawful for a minor to purchase, possess or use any pepper spray in the city.
(e) It is unlawful to sell or offer for sale any pepper spray on premises where liquor or alcoholic
beverages are consumed.
(f) It is unlawful for any person to alter the manufacturer’s name on any pepper spray to be carried or
used in the city.
(Added by Ord. 95-49)

The Senate electric gun amended SD1 bill is out.  It's got everything you asked for.  Permitting and registration.  No matter how much you hate them, you at least gotta give them an "A" for effort.

All the other Senate Bill committee reports and amended bills are out.  I'll update my bill tracker a bit later tonight.

FYI when writing testimony for stuff like CCW and legalizing tasers.  You can oppose the bill, but next to it put you support CCW or whatever but oppose the heavy restrictions on it.

Or else it looks like you're opposed to CCW and Electric Guns.

So are these legal? Says they ship here.

I am pretty sure Hawaii views that as a firearm.  Reason is it uses a 9MM case syuffed with pepper gel.  The primer only powers it.  I have shot the 2 shot model in windy conditions and the wind has very little effect on it up to 20 ft.  I would carry that instead of a  one shot Taser.

Taser has advantages over OC.  5% of people are immune to OC, can be blocked with glasses or a hand, and druggies, mentals, and enraged people can be immune too.

You can get a Taser that includes CONTACT protection in addition to the one-shot projectile.  The device can also summon police to your location when the trigger is pulled as long as it's within range of your cell phone..

When seconds count, the police are just minutes away.  Hell, just give me my Glock 19 with a 15 round magazine.

So an hunter education card to buy ammo is a 15 hour class?  What they hell kind of hunter education needs 15 hours?  Is this include dressing game, making your own deer scent, making your own guile suit?    Geez I've had medical school education on topics that were less than 15 hours.

From what HPD was saying at the house side, you would have to show the seller your gun registration.  The problem that was brought up is when a gun is sold, the registration is not collected by hpd.  Also many guns can take different calibers.  So if your reg only says .357, you can't buy .38.  Also the privacy of info when doing private sales of ammo.  All your info is on that reg, even address.
