You are absolutely correct that the Hawaiian Kingdom Constitution of 1864 did not include a Bill of Rights in the American sense. However, it contained some of the elements that were the major facets of the Bill of Rights.
Moreover, since the illegal annexation of Hawaii in 1898, the slow erosion of the Bill of Rights that came with annexation
was not primarily due to the legal descendants of Hawaiian nationals per se, but
by the descendants of those people who the US allowed to settle in Hawaii since 1898.
