After nothing happened to Christopher Deedy I am sure the Feds feels pretty safe being able to shoot whatever unarmed Hawaii citizen that strikes their fancy.
Nothing happened?
The state says they will try him a third time even though the US Supreme Court refused to hear an appeal to allow a retrial on manslaughter charges. The state plans to file new charges now for First-Degree Assault.
So far, the first trial for a Murder charge alone ended in a hung jury.
Second time, he was tried for Murder including the lesser charge of Manslaughter. The jury acquitted him of Murder, but deadlocked on Manslaughter.
The state tried to charge Manslaughter again, and the appeals court ruled that would be against the double-jeopardy protection of the Constitution.
So, now they are going to lower the charges to Assault to get a third swing at him.
Keep in mind, the McDonald's tragedy was in 2011. The trials were in 2013 and 2014. It's now 2021, and they want another trial -- sometime.
At what point does the "speedy trial" requirement cause this Hawaii justice debacle to just cease? If they wanted to try him for lesser crimes, including Assault, they should have included those in the original trial. As it stands, the prosecution has botched the process, and it's doubtful Deedy will ever be convicted of anything.
In the meantime, the trials cost you and me money, and Deedy's defense, which has already run up a bill to over $800K, is paid by the Department of Justice. Tax payers are funding BOTH SIDES of this circus.
Nobody wins.
