Do any old timers have grandfathered "assault pistols"?
« on: February 18, 2025, 05:12:02 PM »
Assault pistols registered at the time they were banned were grandfathered-in, right?

They'd all be 30+ years old at this point?

Anybody have one?

I wasn't aware there were grandfathered assault pistols.  Don't see a grandfather clause in HRS 134-8

I didn’t know the uzi guy that well.  I had heard about the uzi from my friend that had worked with the Uzi guy.

I’m guessing HI is like WA?  In WA, no new AR/AK but you can keep what you already own?   In HI, you can keep assault pistols registered before the ban?

The relevant language is below, right?
As far as I can tell, HB893, the current "assault weapons" ban proposal, copies the same language for the guns it affects, so if that bill passes in its current form, a ton of guns are going to be grandfathered in the same way assault pistols were in 1992.

§134-8 Ownership, etc., of automatic firearms, silencers, etc., prohibited; penalties. (a) The manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of any of the following is prohibited: assault pistols, except as provided by section 134-4(e); automatic firearms; rifles with barrel lengths less than sixteen inches; shotguns with barrel lengths less than eighteen inches; cannons; mufflers, silencers, or devices for deadening or muffling the sound of discharged firearms; hand grenades, dynamite, blasting caps, bombs, or bombshells, or other explosives; or any type of ammunition or any projectile component thereof coated with teflon or any other similar coating designed primarily to enhance its capability to penetrate metal or pierce protective armor; and any type of ammunition or any projectile component thereof designed or intended to explode or segment upon impact with its target.

§134-4(e):
(e) After July 1, 1992, no person shall bring or cause to be brought into the State an assault pistol. No assault pistol may be sold or transferred on or after July 1, 1992, to anyone within the State other than to a dealer licensed under section 134—32 or the chief of police of any county except that any person who obtains title by bequest or intestate succession to an assault pistol registered within the State shall, within ninety days, render the weapon permanently inoperable, sell or transfer the weapon to a licensed dealer or the chief of police of any county, or remove the weapon from the State.

It is worded oddly, but the Senate Journal in 1992 does back it up
Senator Chang continued:
“And that assault pistol would be prohibited under the
terms of this bill?”

Senator Blair answered:
“Yes, but only with respect to new acquisitions. Those
which are currently registered and lawfully owned could
continue under their present ownership without any
sanctions applied.”

The odds of an AWB passing has gone down since last Thursdays hearing.  Have to keep working on it.

I certainly hope so! Thank you for all that you do.

I spent the last three weeks stocking up on would-be "assault weapons", and now the recent talk on grandfathering magazines has me in a tizzy. I shipped out my 50 cal for some custom gunsmithing work too, in case it's not allowed to come back over the border in a few months. Every year I go through this anxiety and flurry of activity.

I wanted to buy a set of cowboy guns this year. Instead I was compelled to acquire a pile of AR lowers and an AUG. Hmph.

Lol! You should dump that Aug :-)  How much? :-)

I’m the opposite.   Since WA banned AR/AK’s, I’ve been trying to not buy more AR rifles/lowers.   (Have more than enough for my myself and my kids)

If anything, maybe I’ll pick up more bcg’s and hunting uppers…7.62x39, Grendel and 6 arc in case any of the kids ever take up hunting.

If there is panic buying in 2028, you could make a decent profit

Damn.   Maybe I should get an AK too….
