A REAL Buy Back is Paying out at Least 3X Plus Market Value of the firearm.

Would make a lot of people more inclined to "Sell Back" their EBR.

Got this from the NRA just now.  Apparently this "gun buyback bill" has morphed to additional background checks for gun owners. 

I will also contact the HRA to see what their official position is on this bill.

Hawaii: Burdensome Anti-Gun Bill Must be Stopped
Contact your state Senator Today

On February 27, Senate Bill 69 (http://www.capitol.hawaii.gov/measure_indiv.aspx?billtype=SB&billnumber=69) passed out of the Senate Ways and Means Committee by a 10-2 vote with one excused Senator.  What started off as a Gun "Buyback” bill (http://www.nraila.org/legislation/state-legislation/2013/2/hawaii-anti-gun-bills-on-the-move.aspx?s=&st=10475&ps=) has evolved into a firearm registration and background check bill.  This burdensome and unnecessary infringement on your Second Amendment rights is now headed to the Senate Floor and could be voted on TOMORROW.  Your state Senator must hear from you TODAY!

In its current state, SB 69 will require fingerprinting and NICS checks in addition to the already existing registration requirement on ALL firearms brought into the state, and will allocate an unspecified amount of money to each county to process these mandated background checks.

Individuals who bring firearms into Hawaii from another state, even on a temporary basis, are already required to register their firearms within 72 hours.  This bill now adds a fingerprinting, photographing, AND a background check requirement on the owner in addition to the already burdensome registration requirement on such legally possessed firearms.  These requirements are so onerous that if one acquired an antique firearm or an unusable or unserviceable firearm they would still have to undergo the entire background check, registration and fingerprinting process.   Hunters and shooters beware, when traveling to Hawaii make sure to allocate at least one or two days to stand in line to register your firearm and undergo fingerprinting and a NICS check.

In summary, what can be known for sure is that this bill presents no viable solutions that would make improvements to Hawaii, but instead attacks law-abiding citizens who are choosing to exercise the right to own a firearm.

We already do all this just not on a person to person sale right now. What a bunch of clowns the legislature is. They need to really go and get a permit to see what we have to do.....i bet most of them never did.

Serious. We're the only state that requires reg on long guns, and they want to make it even more of a burden..

I heard back from HRA and they have a different take on this bill.  I just asked if they were going to communicate an official position on this and am awaiting for a reply.

Ok, Max said it was okay to post his reply to me so here is their position on SB69.

HRA supports with amendments or hope the bill dies, while NRA opposes (See NRA's position on SB69 here http://2ahawaii.com/index.php?topic=6746.msg66649#msg66649)

So my question is... do we submit testimony in support or opposition to this bill?  Curious to see what you guys think.

The Senate finance committee (WAM) amended SB 69 pretty much as HRA asked. See http://www.capitol.hawaii.gov/session2013/bills/SB69_SD2_.htm  for the SD2 and the Committee report links.

They took out all reference to gun buybacks, mental health checks, county police gun training for civilians, and money for these programs.  They left in a provision that HRA supported, NICS (national instant checks system) checks on owners who register a gun (already required by state law) which they bring in from out of state.  WAM left in the possibility of an unspecified amount of appropriation money for this.

We understand that NRA supports instant back-ground checks with no record keeping, but opposes this bill draft still, because they oppose federal background checks for anyone who has already acquired a gun lawfully outside of federal dealerships, i.e. private sales, a big issue nationally.  HRA and NRA seem to be agreeing to disagree on this one.  Most states have no registration requirement.

The committee ignored our advice that anyone with fingerprints already on file is exempt from another FBI fingerprint charge, currently $16.50, perhaps an oversight.  We hope to either correct that "may" to "shall" discretion for the county police about charging for fingerprints, or kill the bill in during the second half of the Legislative session in the House of Representatives.

Hope that helps.  Please contact us for any further explanation on points I did not clarify.  It's a complicated bill that keeps metamorphosing.

A friend of mine doesn't own a firearm but told me something pretty cool today....

Opposed!  Here is my comment:

Hunters and sport shooters who travel to Hawaii will be required to waste at least one or two days to stand in line and register their firearms.  Paying for a rental car, parking, and hotel accommodations in order to undergo fingerprinting and a NICS check is unreasonable and would become prohibitive to many. 

What happens when a legally purchased and registered firearm from another state is inappropriately confiscated due to outdated or inaccurate NICS data?  Even when the situation is cleared up, the individual's vacation will have been ruined, and the cost of shipping the firearm to the individual's home, or local FFL, will be just another waste of tax payer revenue by the state.  Ultimately, visitors will choose to vacation in places other than Hawaii, and they will warn their family and friends to stay away from this anti-second-amendment state! 

This bill represents no viable or reasonable solutions that would improve the violence rate of Hawaii.  It would instead place an unnecessary, costly, and ineffective burden on law-abiding American citizens who merely wish to exercise their individual right to own and use their legally obtained firearm.
When only cops have guns, it's called a "police state".
