For the 2nd time you're going to be asked. What law was broken?

And For the 3rd time, when does life begin?

The crimes that are prosecuted are determined after a criminal investigation and the evidence is brought to the grand jury. In this case there are many possible crimes to choose from and it would be premature to announce them at the start of any investigation. Also the sherriff doesn't prosecute they investigate. The prosecutor will need to provide you with the crime after an investigation is completed.

Sure, the specifics might make the difference between one crime and another but the Sheriff should still be able to at least name some crime. A cop going to a fight scene might not know whether it is assaut 1st, 2nd, 3rd, etc. but he could still say investigating an assault.

Imagine a cop traffic stoping you but he can't tell you the violation until the prosecutor approves the ticket....

I took a law class at UH. Theres a case in the 80's here. Some guy was arrested and jailed. Then went to court. No where along the way was he told why he was arrested. The judge tossed the case. I dont remember the name.

One possible charge is kidnapping. Also just plain fraud. Along with numerous other laws related to spending the money improperly. So what happens if I lie to someone on the street, make all kinds of promises, give them a one way ticket to the mainland. Then I put them on a bus and drop them with nothing in the middle of the desert and leave.

What is the crime in that?

Please show where De Santis did that.

I'm still trying to figure out how you promised them a ticket to the MAINLAND, and then BUSSED THEM TO THE DESERT!!

How many deserts in Hawaii are accessible by bus?

And where did the bus gas up when going from Hawaii to Mainland ?

We have a hard time keeping criminals that are citizens locked up in jail and someone is worried about the plight of people who crossed our border illegally. Would you offer the same conveniences and freedom to a person who trespassed onto your property? "Hey buddy this is private property, how can I help you?" All this hoopla is because the same people who had this fairy tale idea of poor migrants had their reality crushed when they showed up in their neighborhoods. Plain and simple. It's not about laws, it about reality in their faces.

A free bus ride is not kidnapping, even if you told them there was a job waiting for them.
Fraud? Nope. No one is taking the immigrants money or depriving them of something of value. Only thing they might get is hurt feelings if there doesn't end up being a job.

The only thing close would be the concept of detrimental reliance. So if I told you I had a job for you and you spent a bunch of money moving over for the job but the job never existed then you could sue me for the cost of your moving however in this case the immigrants didn't spend anything, they got a free bus ride so a civil suit would be weak as hell anyway.

Anyone arrested is supposed to be told what they are being arrested for. Doesn't have to be right when the handcuffs are going on but it has to be told to them at some point.

I don't think you know what kidnapping means.

I don't think you know what fraud means.

I don't think you know how to use relevant examples.

Supposed is correct. But this guy wasn't told.  Even while he was sitting in the jail cell.
