The pubic has a right to know the details of the president's medical situation. But the
president has the right to keep his medical information confidential. There is a conflict
between these rights, even when they involve the president of the United States, who
is a candidate for reelection. The reason the public has the right to know about the
president's medical history is self-evident. He is the most powerful person in the world
and he is seeking a second term. Voters are entitled to know the truth about his medical
condition. No one would dispute that.
But there is a countervailing right which few in the media have written about.
All Americans have the right to medical confidentiality. This right is assured by federal law,
state law, medical ethics and the long traditions of the medical profession. What a patient
tells his doctor, or what the doctor observes from the patient, are confidential, subject only
to a few limited exceptions. Among these exceptions is the obligation of doctors to report
threats to other people, such as a highly contagious disease. It also includes the obligations
of doctors and other professionals to report when they learn of abuse of or by the patient.
There is no explicit exception for high ranking public officials, including the president.

The cabinet and VP are able to observe the President day in and day out. They can tell if he's actually running things, or if he's just sitting there reading from index cards a staffer or spouse gave him.
Those are also elected officials, and they have a responsibility to have a sitting president removed for incapacitation. Being too senile or sick from cancer to perform his duties seem to fall under that heading.
I look at it like a drunk at a party. Someone who's wasted probably doesn't have the judgement to not try to drive home, but the host, bartender, friends and others there can clearly see he's too drunk to drive. They have a duty to stop the drunk from driving, just like the cabinet has a duty to act if the president is unable to do the job.
Of course, the political parties are more concerned with maintaining power than getting the job done. As many running for office have said, we have to win before we can do any good. I can't see a Democrat-appointed cabinet and Democrat running mate telling the truth if it means they might not win the next general election.
In short, there's lots of evidence being thrown around now about how bad Joe's dementia was over a year ago and beyond.
If that evidence was available to Harris, to Party leaders in Congress, to Biden's cabinet, and even to the First Doctor-Lady, Jill, i think a case could be made that they committed fraud by gaslighting the public until they no longer could.
