Legal and Activism / Re: Reason given for concealed carry permit
« on: March 02, 2015, 03:13:54 AM »
When I applied for my non-resident New Hampshire permit they suggested 'All Lawful Purposes' as a suggestion for the 'why are you applying for a permit' question.  Of course I know that nothing short of a lightning bolt from Heaven striking the chiefs of police in Hawaii will get a permit granted there.   :worship:

Moved to Florida where it's much more gun friendly.

Off topic....   When I went thru Honolulu International with a bunch of pistols, I just asked the lady for a firearms declaration card.  No problem at all.  They ( airline counter folks ) just asked if the guns were unloaded.  TSA was not involved at all.  I signed the card and put it in the case.  Picked up the case when I arrived in Florida.  ( it should always be that easy )

Regarding taking guns to the airport for travel.  I just spoke with an officer at the HPD firearms unit.  He said that would be covered as to/from 'place of sojourn' under HRS statute.

So when moving out of state....  and taking firearms with yous declared and checked baggage on an airline to your new home....   you would be en-route to home from your 'place of sojourn or from your current residence to your new 'place of sojourn'....

( I think )

  ???    :wtf:

I will be very happy in my new gun friendly state of residence.

"Or a miracle could happen and the Hawaii legislature and/or Police Chiefs could decide that "You know what, you DO have a right to carry for self-defense. We have been enforcing an unconstitutional law. We'll start issuing those "licenses" right away." "

It's nice to dream...

Th ank youfor the update, Chris...

It's amazing how calm and polite the pro gun folks are and how vitriolic the gun control folks get when the freak out...

a contrast in opposites...  both in their views and in their demeanor.

I printed a copy for the Big Island carry permit. Do we really HAVE TO have a reason to carry? Or can it be just self protection plain and simple. What should be my purpose? I am a former ACO and now Deputy Sheriff E.H. Is that purpose enough?? I CAN be issued a permit by law BUT..... L.T.  will not issue a permit to any E.H. Just wondering Funtimes. Any help would be appreciated.

If I remember right ....  New Hampshire suggests 'all lawful purposes' in their instructions as a valid reason for a permit.  But I'd take Chris' advice and wait.

A BIG mahalo to Alan, Richard and Chris for all their efforts in this long drawn out battle....

Just seen in the Patriot Post this morning....   Not sure how it will all play out...

"Hawaii Becomes Shall-Issue
The Ninth Circuit Court recently ruled in Peruta v. San Diego that California residents did not have to show a "pressing need" for a concealed weapons license. Thursday, the Ninth Circuit extended that to Hawaii by overturning a district court ruling and thus making the Aloha State a shall-issue state. The Court said, "In light of our holding in Peruta, the district court made an error of law when it concluded that the Hawaii statutes did not implicate protected Second Amendment activity. Accordingly, we vacate the district court's decision denying [the plaintiff's] motion for a preliminary injunction and remand for further proceedings consistent with Peruta." We're glad to see that even the Ninth Circuit acknowledges that the Second Amendment means what it says. "

".... and Baker was not amongst them. Wonder what's taking them so long?  "

Me too...  & I'm sure a lot of others....Keeping my fingers crossed for good news soon.

The AG has filed belatedly as a Proposed Appellee Intervenor. Here is the filing the Peruta team has until March 26 to present an argument against

http://cdn.ca9.uscourts.gov/datastore/general/2014/02/28/10-56971_motion_to_intervene.pdf

In oral argument, all the judges were snickering at the AG who did not want to get involved but made certain she was notified that she could be but she declined to during the case.

Here is the actual audio of the oral argument direct from the courtroom:

The amazing part is were James Chapin states that "A handgun and two clips is a weapon of mass destruction"
I have never seen or heard of a handgun that can load or fire a clip.

Link didn't work for me...  tried 2 browsers....  both said 'video is unavailable...    >:(

It seems the 'Legislative Process' here is far to Machiavellian for my simple mind to understand...   >:(

Copied it, pasted it, sent it. Now for the reply.

I did the same...Modified the original letter and sent to the representatives.

Thanx to punaperson for a great letter.

I modified it slightly, just so it's not identical, and sent to each and every senator.

I'm Chris's lawyer along with RIck Holcomb. Do not apply for a CCW right now. You will just be denied. Wait until at least Baker comes out.
As for carrying long arms, that issue is going to be resolved in Young. Hawaii conceded that Hawaii's complete ban on carrying rifles and shotguns is unconstitutional.
Still you'll have to wait for a decision in Young for that concession to mean anything.

Thanks Wolfwood.
