Jussie was never charged with a hate crime. He reported a hate crime directed at him for being Black and Gay.
Now, since he reported the attackers said racist and homo[phobic things, the attack on him (if it happened) is still a hate crime.
Jussie repeated his claim that the 2 who attacked him said those things.
The Nigerian brothers admitted to the grand jury under oath that they were there that night.
So, it's reasonable to assume if Jussie is telling the truth, the Nigerians attacked him and should be charged with a hate crime.
But, Jussie said his attackers were white.
Did Jussie get beat up twice by 2 sets of guys -- one white and one black?
Both the state and the feds can charge the Nigerians if they go off what Jussie said and what the bothers admitted to.
Apparently, the brothers' lawyer told them to make a public statement that Jussie is lying, and that the attack was staged, because they really are at risk of being charged.
The brothers decided instead to say nothing. One wonders if that $3500 check got a few zeros added last week.
The brothers' lawyer then quit. Hmmm...
And the sealed records may be unsealed soon. Apparently that was something the prosecutor screwed up on. Jussie's lawyer made the motion to have the case file sealed, and the prosecutor didn't object. It shouldn't be a big deal to unseal them. That happens all the time. Just takes a judge's signature, especially if there's no justification for sealing it other than "Privileged, politically connected, rich Black Gay celebrity".
