It's started - get ready to help defete anti-gun legislation in Hawaii (Read 14203 times)

HiCarry

The 2011 legislative session has begun and an anti-gun bill has already been introduced. HB 441, introduced by Rep. Blake Oshiro (a strident anti-gun politician who has introduced and supported other anti-gun measures in the past)

HB441 has several parts, but in part seeks to ban .50 caliber guns and ammunition, require overly restrictive measures on storage by gun dealers, prohibit disclosure of the reason an applicant was denied a permit, and restrict ammunition sales to those with a valid registration for that type of firearm.

Get your pens sharpened and tryto make it to any scheduled hearings......

What needs to be done, and who do I write?

For starters, I would suggest calling your legislator(s). Let them know you do not support this bill and will hold them accountable if they support or don't try to kill it. I would develope your argument as to why you don't support it (i.e. Banning 50 cal guns/ammo is a "solution" to a problem that doesn't exist, as no crimes have ever been documented with this firearm; restricting ammunition purchases to those that have a registered firearm of that caliber would hamper efforts to train non-gun owners or those gun owners who would like to try out other guns, say a friend who wants to take them to the range but asks that they purchase ammo to cut costs).

Use these arguments to prepare any written testimony (or verbal testimony if you can attend any of the hearings that may be scheduled). It is important to get your testimony ready now because the hearing notices often come up with little notice.

Yes, I am working on a response to Carrie Herbertson at the NRA. I think we'll be able to use their e-mail notification system. The HRA will of course oppose it, but we'll also need to make sure to generate a ton of testimony if it makes it to a hearing. In the meantime, I would suggest contacting your individual legislators, as well as those on the committees, PSD and JUD, and let them know how you feel.

Are there any pro-firearm legislation in the works?

Would be nice if the retort is in the form of some kind of positive reform such as repeal of the Useless Firearm Registration laws(massive waste of tax payers monies), Magazine capacity limits, or dare we say Shall Issue?

This amends 134-10.5 to require if you have reasonable knowledge that your firearm could be accessible to children;

Ensures that the firearm is equipped with a firearms safety device, as defined in section 134—A; or

Heller vs. DC anyone?    We need people to start spreading this word, point them to HDF / HRA, so we can get a public word out there and take this stuff down.  I will not go down easily. In fact, it looks like I have some research on injunctions to do, because if we can't get lawyers to do this, I wont stand by and watch this go through without question.

Yes. HRA was going to try and get a bill introduced regarding the magazine limit, but some of the "friendly" legislators backed off because of the Tucon incident. There is also a limited liability bill related to firearms instructor, and I believe a couple of legislators were going to introduce concealed carry bill. Those are the ones I know of off the top of my head....

Great. This guy should be OUT! anti 2A and pro "civil unions"
Blake Oshiro (born January 16, 1970) is an American politician, currently serving as Majority Leader in the Hawaii House of Representatives. He represents District 33, comprising the Honolulu neighborhoods of Aiea and Halawa. He was first elected to the seat in 2000, taking office the following January.

Oshiro came out as gay during the debate over Hawaii House Bill 444, which granted civil union rights to same-sex couples in Hawaii.[1] He subsequently faced a socially conservative primary challenger in his 2010 race for reelection, Honolulu City Councilman Gary Okino. Oshiro defeated Okino by 56 percent to 44%.[2] In the general election held on November 2, 2010, Oshiro was reelected over Republican opponent Sam Kong by a margin of 54.5% to 45.5%.[3]

Oshiro will be the only openly LGBT member of the Hawaii State Legislature when the new session convenes in 2011. Rep. Joe Bertram (D-Maui), the other LGBT member who served in the 2009-2011 session, was narrowly defeated for reelection by his 2008 Republican opponent George Fontaine.

prohibit disclosure of the reason an applicant was denied a permit,

none of this makes any sense, but, this takes the cake.  why would you not disclose the reason for a permit denial?  they could just start denying permits to law abiding citizens and not give a reason why, which would put someone denied in a really shitty situation.

What kind of "back up" are you looking for? Is the program live? If so, where is the studio and/or what time is it scheduled?

I'm bettin' that they'll say it is to protect the medical provider who might fear some retaliation from the applicant who was denied a permit. The problem, for us, is that the provision can be made to sound reasonable. If you look at it from the point of view of some psychologist or psychiatrist who feels someone is truely dangerous, you can understand why they might fear that person knowing who said what. HOWEVER, the issue becomes more grey when those providers can say someone is "adversely affected" and not provide any details to substiantiate such a statement. I have heard of folks denied permits for a history of bedwetting as a child and another for seeking grief counseling after the death of a spouse. That's why there needs to be an appeal process that requires the disclosure of the substantive reason for denial.

That is a good idea....and I would encourage anyone who lives in the Aiea area (i.e. Rep. Oshio is your legislator) to call and let him know you do not support this bill and want him to kill it. He won by a very slim margin and may be more readily influenced by constituants concerns (i.e. voter in the next election cycle). Keep it civil and on point, but let him know how you feel. This same suggestion would apply to your legislators in general, but especially so if any of them are on the two committees (Judicary and Public Safety) scheduled to hear them.
