Making a semi auto AR pistol
« on: October 23, 2013, 06:41:26 PM »
Just waiting for the pistol receiver to be milled out of an 80% from one of the Rockethub campaign.
Several ways around the "assault pistol" definition.
Non banned pistols include :

1) non detachable magazine - if the pistol magazine cannot be removed
2) semi auto operation - as defined by HRS definition of a semi auto
3) 16" or longer barrel - if the pistol has a 16"+ barrel
4) a C&R pistol
      all subsections ( 50oz, threaded barrel, mag outside pistol grip, etc.....) do not apply if any of the above is meet.

below is the complete HRS section 134-1 definitions for an assault pistol:

"Assault pistol" means a semiautomatic pistol which accepts a detachable magazine and which has two or more of the following characteristics:

     (1)  An ammunition magazine which attaches to the pistol outside of the pistol grip;

     (2)  A threaded barrel capable of accepting a barrel extender, flash suppressor, forward hand grip, or silencer;

     (3)  A shroud which is attached to or partially or completely encircles the barrel and which permits the shooter to hold the firearm with the second hand without being burned;

     (4)  A manufactured weight of fifty ounces or more when the pistol is unloaded;

     (5)  A centerfire pistol with an overall length of twelve inches or more; or

     (6)  It is a semiautomatic version of an automatic firearm;

but does not include a firearm with a barrel sixteen or more inches in length, an antique pistol as defined in this section or a curio or relic as those terms are used in 18 United States Code 921(16) or 27 Code of Federal Regulations 178.11.

Thus, HRS allows a semi auto AR pistol with a detachable magazine (limited to 10rds) , if the barrel is over 16" but without a stock as defined under { 18 USC chapter 44 sec 921c (7)  and definition of a  "handgun" 18 USC 44 sec. 921c (27A) }.

Just last year I register an AR pistol already, just a couple of odd looks but it was register and out the door.

 :thumbsup:

Clearly not an assault pistol, so what's the point of it? Why not just get a 10-rd pistol? Not criticizing but just curious.

Fixed like you have to break the rifle open and load it through the Lower or like a California bullet button?

This is what he showed he has in another post which isn't a 16" barrel. I'm a little confused but that's normal.

It's going to be a new build.

Just saying that the assault pistol ban can be skirted in 4 way.

And able to shoot 5.56 on the pistol range at kokohead.

Something different to shoot and to put insult to HRS134 when registering.

Yep, got an MPA Mac 9mm that's done the way . But it holds 30 rds.
Magazine is welded to the grip.

Thus,  is not limited to 10rds for magazine. Since the "firearm" holds all 30rds not the "detachable magazine" as defined by
HRS134-8c.

HRS 134-8(c)
(c) ..................... or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds which are designed for or capable of use with a pistol is prohibited. This subsection shall not apply to magazines originally designed to accept more than ten rounds of ammunition which have been modified to accept no more than ten rounds and which are not capable of being readily restored to a capacity of more than ten rounds.

   it has no release lever for the magazine and welded  behind the plastic grip.
much like a pinned and welded muzzle device on a 14.5 barrel

Basiclly the upper is taken off and loaded from the top with 30rds.
But Kokohead only allows 5... :'(
