High capactiy handgun magazine kit analogous to a Molotov cocktail? (Read 2625 times)

So I was having a conversation with a friend of mine about our state's silly gun laws, and the subject of 10 rd. handgun mags came up. He was trying to tell me that buying and owning a handgun magazine kit that could theoretically could hold more than 10 rds. is illegal. I was trying to say that owning a magazine kit is the same as possessing gasoline, a bottle and a rag. In their separate forms they're perfectly legal to own, however, as soon as you construct them into a Molotov, then you constructed an illegal device. Likewise, just having the parts to say a 33 round Glock magazine is legal, but as soon as you put them together, then you've broken the law.

So who's right here?

From the discussions and reading the HRS, magazine repair kits are legal.  An assembled kit capable of > 10 rds capacity for use in a pistol is a misdemeanor.  Inserting that assembled mag into a pistol, even without ammo, is a felony.

all I know is that you had better not put a silencer on to that bottle or rag!!!
