Update: Maui man's racist rant could result in park ban, criminal charges (Read 17165 times)

Bunker

Just seen this update on the news about the Maui incident.

The 21-year-old man who went on a racist rant that was caught on cell phone video could be banned from all Maui county parks for a year.

Maui Police are also moving forward with Terroristic Threatening and Harassment charges, both misdemeanors.

The man is considered homeless and has been arrested and cited several times for disorderly conduct.

Older arrests were for possession of drugs and domestic abuse.

It really seemed as though the MPD should have pursued enhanced charges related to the racial context of the terroristic threats and harassment. Hopefully the prosecutor will pursue the elevated charge, which I believe to be appropriate and inline with the video evidence we have all seen. If his lawyer can work a favorable plea agreement as his case proceeds good for him, that is our justice system. A clear message, though, needs to be made that this type of behavior will not be tolerated AT ALL!

+100 Definition of hate crime.  Maybe only because it was verbal they are not pursuing the elevated.  I am just glad they are doing something because that kind of activity (by anyone) is just plain bullshit!

That rant is no "hate crime".

It's just some skinny punk that hasn't got beat up yet and thinks he's tough.

When I was growing up, this dummy would just get licked and stop acting up.

Today, everybody is so pussified that they cry "hate crime" and want to lock up for life some idiot saying stupid stuff.

Since when is exercising a Constitutional right, like freedom of speech, a crime?

Would I have been uncomfortable, even scared, in that situation?  Of course I would.  Would I have drawn a gun?  Nope.  Would I have called the cops?  Probably not in the minute-and-a-half this lasted.  So he hates white people and has a big mouth.  So you don't like what he had to say.  And?  That's why it's a Constitutionally-protected right, so that you can say things that make people scared or uncomfortable without being locked up!

Not all speech is protected.  There's a line you can't cross.  Crying fire in a crowded theater, inciting violence, terrorizing someone, etc.  Civilized people should have civilized recourse when dealing with uncivilized people, even if it's just words they are using.  That's what laws are supposed to do.

I have a right to enjoy the park with my family without being threatened and accosted like in the video.  Sure, smacking the loon would make you feel better, but it escalates the conflict, and it makes you no better than the ranter.

I'm interested to see what charge Maui pulls out of their ass. At the most it's TT2 or disorderly conduct. The only actual crime I see is disorderly conduct. If the victims were really that terrorized they would of left. They stayed. That kinda defeats the charge.

Don't see a hate crime here. If he would of struck one of them then it's a hate crime. The only thing he did was threaten to break their phone.

Yep.  What do you bet that if brown kid was popping off and then haole boy went and lick em, haole boy wind up in jail for, you guessed it, hate crime.  Back in the day you act up, you get lickins, end of story.  Now.....yep pussified.

When committing a crime(Harassment, Threatening) and the victim of the hostility is selected based on in this case their race.

If the Haole guy kicked his ass, not only would he end up getting arrested, before PD showed up he would have been jumped bu the other chronic "witnesses".

That is sarcasm right? IMHO society has 2 options when it come to encounters like this. 1. Brawl and risk losing your rights if convicted, and risk life as ANY physical altercation carries that risk especially with unknown opponents and variables 2. Try to walk away if they let you. I agree with the theory of putting people in their place, but in this day and age, that comes with a high probability of a lawsuit or worse. So should society let these scrubs say and treat people however they like because they have "a big mouth"? I'm not going to risk my rights, life, and possessions just because someone has a big mouth, but I also have a big problem with letting punks terrorize and threaten other people especially for bullshit reasons like ethnicity.  Everyone has the right to life, liberty, and happiness. "Scaring" and making people "uncomfortable"  violates those last two rights. He deserves to get locked up for violating their rights in the way that he did. If you don't think so than your more than welcome to put him in check the old fashioned way and I would salute you for it. I have too many people dependent on me to risk jail, lawsuit, or death, but this type of behavior should not be tolerated either.
