"Gun Show Loophole"

Ok we've all heard about the crying from the VPC/Brady/Mayor Bloomy about the so called "Gun Show Loophole". If I recall a study showed that 0.8% or less of all actual gun crime could be traced to a gun show firearm.

So Obama's fix under S.436 is:
-ban all private person-to-person sales of firearms, requiring that all sales go through federal firearms licensees or the police, who would conduct a background, check [Title II].

I disagree with this approach (for gun shows). When I was stationed at up at Cherry Point, NC I'd say go with their approach to firearm sales at a gun show. The Sheriff's department sets up a table at the show. If you're interested in purchasing, you provide valid ID; they then run a NICS check on the spot. If you pass, you get a piece of paper clearing you for any and all purchase(s). Simply present the paperwork to any seller, and you're valid to buy. Basically remove the burden of the seller to be a FFL, and put the onus on the Federal to perform the checks.

But this would not be mandatory for the event itself. If the Sheriff’s department fails to provide the support to do the NICS checks (shortage of man power/logistical support), the gun show as a whole may still continue with the event. Sellers/buyers are still clear to perform sales; current procedures would remain in place (Valid Photo ID). Think of it like any major event, special duty police "can" be on site to help with traffic/crowd control/etc. But the event doesn't "need" them to host and run the program itself (Concert/Sporting Event/etc).

Oh and the cost of having the Sheriff department NICS checks are not shouldered by the host of the event, as they are not "required" to have them (SD) on site to run the show. It comes out of the department's budget to pay for the personnel and supplies to run it. Basically don't penalize gun owners for exercising our right to own firearms, spread it around equally to all. (After all shouldn't the anti-gunner's be held responsible for helping keeping guns out of criminal's hands too?)

Just my 2 cents. I think we should keep rapists/burglars/domestic abusers away from firearms. But that has to be balanced against putting an overly large burden upon private sellers too.  :shaka:
