Resident Non U.S. Citizen Needed For Lawsuit
« on: May 21, 2014, 09:32:15 AM »
Well friends the fight for your rights goes well. However due to the unpaid nature of that fight I have to let Baker, Fisher and Young play out as all potentially have a lot of work involved in them.
Fisher gets heard for the last time on June 12th and 134-7 crime of violence provision will undoubtedly be struck down. I can assure you that opinion will be appealed.
Baker is going through the same en banc process as Peruta and there is a strong chance of  Supreme Court review.
I doubt Young will be heard until after all the handgun carry issues are resolved in the Ninth.

That being said this is a great time to ask Hawaii's Second Amendment community to find a resident alien or U.S. national.  The reason for this is the Second Amendment Foundation has a standing policy of challenging such bans. The reason is these cases are guaranteed wins. There is no reason U.S. Nationals (born in America Samoa) should be denied firearm rights and the most important thing is for us to keep up the pressure do they think twice before passing a nonsensical law..

If you know anyone living here on a green card who has been in the country for at least a couple years see if they would consider being a plaintiff in this suit.  The first question they will ask is whether this could impact their green card. The answer to that is not unless they wish to face federal jail.  Any U.S. national would be great as well.

Simply put its up to our community to find a person willing and able to be the plaintiff. PM me if you find someone.

I apologize if I am derailing this thread however you mentioned on one of the Calgon's threads that Hawaii conceded their ban on switchblades, butterfly knives, and carrying rifles and shotguns. was this during Baker's case? If so when do you think those statutes will be officially null and void.

While I do not know of any noncitizen residents of Hawaii, I have been involved in this issue for a few years now. I gave Alan At SAF a list of states that had citizen only discrimination laws and he has been working off of that list.

I am sure that you already know this however in case you do not I would reference the material that Comm2a used in Fletcher v Haas in the First Circuit.

That was Young.  Baker is just about the handgun carry law now.
No idea on Young. We haven't even had oral arguments.
The Peruta/Baker/Richards mess will be resolved before that gets heard
