Hey Q, that pretty much mirrors my experience trying to get a direct clear answer regarding CCW and/or Second Amendment issues from my public servants. I don't belong to Facebook, so I haven't had the privilege of being banned from any of their sites, but I have failed to receive responses via email and phone. It's what they (most of them) do. And there are no negative consequences for their behavior, because they know if they keep promising unicorns and rainbows to their subjects, those subjects will continue to vote for them. My "representatives" not only don't represent me or protect my rights, they won't even talk to me about the issues. Of the people, by the people, and for the people. I call bullshit.  :geekdanc:

If he's using the page as a public official I don't think he can legally ban you. That's the basis for HDF's legal victory against HPD's FB page banning him.....

To be fair he is only addressing issues that Hawaii voters care about. Do you think the right to defend themselves is a paramount issue? I'd guess that most people in Hawaii will just call 911 AFTER the crime, thinking that there was no way to defend themselves. When you think about the laws we have, it is stacked against the law abiding citizen. Who do you think already won when a criminal breaks into your home?

He's sworn an oath of office to "support and defend the Constitution of the United States, and the Constitution of the State of Hawaii", so even if none of his constituents "care" about the civil rights regarding keeping and bearing arms he has a sworn duty to uphold those rights. On a "practical" level, since there are no real electoral (because so few Hawaii citizens care about those rights) or legal consequences when he disregards his oath of office regarding said rights, why should he care? I'm sure he has many "more important" issues to deal with that have the real world outcome of gaining or losing votes in the next election. Thus our only hope for legislative remedies is to elect legislators that take that oath of office seriously in regards to the Second Amendment (and the identically worded Article I, Section 17 of the Hawaii state constitution). Bottom line: we're in Hawaii, ain't gonna happen for a long long time, if ever. The courts are our only hope.

Only if they have posted a Terms of Use for their page, or Q violated the FB terms.  Either way, it can't be up to some ambiguous "standard".  It has to be articulated so it can be applied evenly.
