Do I need a lawyer?
« on: April 24, 2015, 07:55:08 AM »
Hello everyone,
I'll keep this as short as possible, I purchased a camera (go pro type) went for a bike ride with their mount looked down camera gone when I reached my destination. Waited a week and they said my camera will be replaced when they get a shipment in but, said my SD card and mount would not be covered. I made a post on their website with my initial conversation and yesterday when I found out they were not replacing mount and SD card. They deleted both comments, I am await of the HPD deleting comments and suspected they would do the same so I took a screen shot of my post. I posted on their FB all of this and am waiting for a response but, I am guessing they will try some sorcery and I might need a lawyer, problem is I have no idea what kind and I know you kind folks are more experienced than I. Any help is greatly appreciated, thanks again!

GoPro is a private entity, with no requirements for respecting your free speech, public disclosure, whatever.  They can delete comments from FB or their website.  You've got no grounds there.

Read the warranty that came with your bundle.  It will spell out what they, and you, agreed to in terms of restitution.  I'm willing to bet that what they are replacing is exactly what the warranty states.
The difference between theory and reality is that, in theory, there is no difference between theory and reality.

GoPro is publicly traded. A lawyer is going to cost more than its worth, which they know. I agree read the warranty and try to work with them.

I recommend that everyone get a lawyer irrespective of whether one is needed and no matter what the cost. But then again, I'm biased. :)

Your right to recover is based on your warranty, not what they said. Look to your warranty for your remedy. If the mount failed because of a manufacturing defect, you probably have a viable claim against the company. If it was caused by user error in its installation, you are SOL.

If you purchased the camera, mount, and SD card using a good credit card, sometimes they have accident/loss/theft protection, usually good for up to 30 to 90 days after purchase and regardless if it was your fault or not.  Look through your credit card terms of use to see if you have it, then call the credit card company and report it.  Give them a description of what happened and that you tried to work it out with the manufacturer but didn't work out.  They may give you a refund for your cost.  If over that period, many cards will have extended warranty benefits and you could try it that way too through the credit card company.

If you bought it through a store or place like amazon.com, then contact that place to see if they would replace it.

If you hire a lawyer, you'd spend $1,000 for a $50 part.  And lose.

Another thing you can do is give them a negative reviews on yelp and other websites (amazon, etc).  Many legit companies don't want bad reviews and may contact you to try and fix it.

What is the total value of the Camera and accessories?  The reason I ask is I've seen consultation fees in the $100's an hour so I'm wondering if the juice is worth the squeeze for this.
