Medical Information Waiver

Aloha All,

New to 2aHawaii and returning to shooting after a few years.  Looking at getting another log gun and have a couple of questions on the Medical Information Waiver:

1)  Will just the doctor that you list (your current provider) be contacted?  Reason I'm asking is because I'm not sure of his stance on gun ownership and what happens if he does not respond to the Waiver?

2)  It is a good idea to give your Doctor a heads up as a courtesy that a Waiver will be sent to him or her from HPD?

You sign two forms, therefore authorize two organizations, to share your information with HPD.  A Medical information Waiver for your personal healthcare provider, and a Mental Health waiver for the state Adult Mental Health Division.  Those are the only two places that will be contacted.

For the medical information form, if you have an HMO, chances are no doctor will ever look at it.  Some clerk will complete the form based on information in your record.  If you have never seen anyone for counseling or mental health.  you should be good.

If you have a local doctor outside of a large HMO, hospital or clinic, then you should probably give the provider a heads-up that they may see the form from HPD soon.  Never hurts to bring the subject up since he/she will be asked about your fitness to own guns.

The process is designed to be hands-off for you.  You sign the waiver, HPD sends it to your provider, and the provider replies.  If the provider fails to reply, your application should still be approved.

HRS does not require this information. As we learned in Criminal Law 102  "onus probandi"

A Doctor is not required to obtain a permit. If you do not have a Dr. simply fill in "NONE or UNKNOWN".
The law only requires the applicant to give access to any records of "mental health".
Thus, signing the waiver is all that is required.



HRS 134-2
(c)  An applicant for a permit shall sign a waiver at the time of application, allowing the chief of police of the county issuing the permit access to any records that have a bearing on the mental health of the applicant.
