At the direction of (Maui) Fair organizers, an MPD officer ordered the Goodhues to leave not just the Fair area, but other nearby public sidewalks as well.
The ACLU and the law firm of Davis Levin Livingston filed a federal court lawsuit shortly thereafter.
The County of Maui and its police have a sworn duty to uphold and protect the free speech rights of everyone on the Valley Isle,
County of Maui had in turn sued the Maui Fair (“Fair”), whose insurance carrier will pay damages and court costs.
Payment: No later than thirty days after the Effective Date of this Agreement, Defendant County shall pay the sum of
$70,000.00 via one check payable to “ACLU of Hawai‘i Foundation Clients’ Trust Account”
plus
$6,000.00 to Plaintiff Stratford Goodhue as damages;
$6,000.00 to Plaintiff Doreen Goodhue as damages;
$58,000.00 as attorneys’ fees and costs to be apportioned between and among Plaintiffs’ counsel as Plaintiffs’ counsel deems appropriate.
