At the direction of (Maui) Fair organizers, an MPD officer ordered the Goodhues to leave not just the Fair area, but other nearby public sidewalks as well.

The ACLU and the law firm of Davis Levin Livingston filed a federal court lawsuit shortly thereafter.

The County of Maui and its police have a sworn duty to uphold and protect the free speech rights of everyone on the Valley Isle,

 County of Maui had in turn sued the Maui Fair (“Fair”), whose insurance carrier will pay damages and court costs.


Payment: No later than thirty days after the Effective Date of this Agreement, Defendant County shall pay the sum of $70,000.00 via one check payable to “ACLU of Hawai‘i Foundation Clients’ Trust Account”

plus

$6,000.00 to Plaintiff Stratford Goodhue as damages;
$6,000.00 to Plaintiff Doreen Goodhue as damages;
$58,000.00 as attorneys’ fees and costs to be apportioned between and among Plaintiffs’ counsel as Plaintiffs’ counsel deems appropriate.

defendant Avery Chumbley who serves as Maui Fair president and  former State Senator.



Former state legislator Avery Chumbley has been elected chairman of the Hawaii Health Systems Corp. Maui Region board, according to an announcement.

Chumbley, the president and chief operating officer of Wailuku Water Co., succeeded attorney R. Clay Sutherland as board chairman May 7. Chumbley

previously served as chairman for the HHSC statewide system from 2008 to 2014. He was appointed to the Maui Region board in May 2014.

Imagine that in addition to the settlement, the ACLU would have gone after the individual officers under a civil rights lawsuit and won. Then, the officers would have been personally responsible and the tax payers wouldn't be on the hook for the settlement amounts. Furthermore, other officers, who should have know this very basic legal concept, might think twice about future such interactions and unlawful demands.
