Transfers of "Assault Pistol" in Hawaii.

If anyone was lucky enough to own one before 1994 , these can be transferred in your "Will". Or plans to purchase and bring into the State of Hawaii in the far future.
A part of HRS134-1 is pasted below, the center body was removed for clarity.


"Assault pistol" means a semiautomatic pistol which accepts a detachable magazine and which has two or more of the following characteristics:
but does NOT include a firearm with a barrel sixteen or more inches in length, an antique pistol as defined in this section or a curio or relic as those terms are used in 18 United States Code 921(16) or 27 Code of Federal Regulations 178.11.



"Curios or relics"
Firearms which are of special interest to collectors by reason of some quality other than is associated with firearms intended for sporting use or as offensive or defensive weapons. To be recognized as curios or relics, firearms must fall within one of the following categories:
(a) Firearms which were manufactured at least 50 years prior to the current date, but not including replicas thereof;
(Firearms automatically attain C&R status when they are 50 years old).

As you can see C&R items are not "Assault Pistol" per the law. Thus, any C&R pistol is LEGAL in Hawaii and can be transferred, or purchased, etc...
27 CFR 178.11 has be reassigned with the new regulation 27 CFR 478.11 since the ATF is now under the Dept. of Justice.

Here are some timelines as to when certain model will be eligible for C&R under 27 CFR 478.11

As you can see a few Mac 10 are eligible for import into Hawaii in a few years.

A C&R license is not required to purchase C&R firearms. This type of license only serves a convenience for collector, NOT to undergo a background check on every purchase and allow firearms to be mailed directly to the collector.

I just wish I knew how having Kaiser is going to affect my ability to buy C&R pistols?
