Has anyone been following the DUI cases on the news?
http://www.kitv.com/story/30609275/attorneys-thousands-of-hawaii-dui-cases-could-potentially-be-dismissed

They can rule that their 4th amendment rights were violated, but yet it takes 4 years to make a ruling on our 2a rights?

Now all theses people charged with a DUI with get their cases thrown out??
Land of the free, because of the Brave!

The rule was passed in 2011 it says so its been 4 years since the first potential cases. As soon as that law passed I didn't know what they were thinking as the legal challenge seemed pretty obvious.

The cases won't be thrown out necessarily but the breath or blood results will be. That means that the strength of the DUI will be based on the officer's observations, the driving, and the field sobriety test. Not as slam dunk but still doable.
