Transferring handgun from Hilo to Honolulu
« on: January 20, 2016, 08:04:35 PM »
My brother who lives in Hilo will be transferring ownership of two handguns to me. Once I send him my permits to acquire and he sends it backed to me signed, I will go and register them here in Honolulu under my name. Question is, does my brother have to do anything else on his side in Hawaii County?

Thanks in advance for any advice.

Send a bill of sale / notification of sale with all the firearm(s) information, as well as his and your information to the Hawaii County Firearms Department, as outlined in HRS 134

First,Hawaii County Police Department has a PDF on their website that can be used to notify them of the transfer of a long gun  .....

Quote
If you sell or transfer the ownership of a rifle or shotgun, you must submit a Sale/Transfer of Rifle/Shotgun form (PDF) (HTML) to the Hawaiʻi Police Department

within forty-eight hours of the transfer via hand delivery or registered mail. The form must be completed and  signed in ink by the vendor or transferer

HOWEVER .....  For a handgun .....

If you sell or transfer the ownership of a handgun, you must obtain the recipient’s permit at the time of sale or transfer.

You are required to sign the permit in ink and submit the permit to the Hawaiʻi Police Department within 48 hours of the transfer via hand delivery or registered mail.

The new owner (you) will receive one copy of the permit back, just like in a gun shop purchase where they keep their copies and you get one to use for registration.

The reason handguns and long guns are different:  you won't ever have a specific permit for a long gun, so the PDF is used for sending to the police department.

Sorry, just to make sure I understand, I should get my permits to acquire (one for each handgun), make xerox copies, mail them to my brother and have him sign one set to send back to me, then he needs to submit the second set within 48 hours to Hawaii county PD?

I'm not sure if you have ever purchased a handgun before.

The permit has multiple perforated carbon copies.  I believe Honolulu PD keeps one when you pick it up.  The seller keeps one (original I think, but don't quote me), and one for you to use for registration.  Hopefully the copies are labeled to say who needs to turn them in (buyer or seller).  I would just ask the officer at the window when you pick the permit up to make sure.

You will need to send both copies Honolulu PD gives you to your brother.  He will need to sign both copies, send the one he kept to his PD, and mail you the other copy.

Once the registration is done, you won't have any copies of the permit to acquire left.  All you need in the end is the final registration form.

or you could just have your brother send them to an FFL, then you don't need to worry about this problem because you will pick up/transfer the firearm from the FFL.

For the FFL fee, it'll make everything much easier and ensure compliance with our "common sense gun safety laws".  **Gag!!*

If you haven't done a handgun purchase before, this is probably more complicated than you should cut your teeth on.

Totally your choice.  If you can find someone who knows the process to hold your hand through it all, either way you should be fine.
