So I was thinking about placing an order for the cz scorpion Evo carbine which comes standard with a 20 round mags however I was told since we (HI) have a 10 round mag cap, I could only receive the 10 l round mags.
Yes we have 10 round cap for handguns but not rifles so why can't I order the rifle with the 20 rd? Why, well I was told since they make a pistol version of the the scorpion that's why and plus it states on the cz website we have a max cap of 10 rds. I don't get it though cuz we do not have a 10 Rd cap for rifles and I would like to purchase the rifle version of the scorpion not the  handgun as it is not legal in its form for us here in hi. Well I decided not to purchase if I could only have 10 rds in the mag. Makes no sense when I can put whatever I want on my ars. So does the 10 round max apply for all rifles to now??

An AR pistol, by HRS definition, is an assault pistol, which makes it illegal in Hawaii, which is why you can have rifle mags because owning a assault pistol is not permitted.

CZ scorpion is likely in the same classification, which means that companies wont ship firearms with magazines that can be accepted in both a rifle and pistol, even if the pistol version does not meet the full criteria of the hawaii definition for an assault pistol.

With the advent of pump action AR pistols, and other pistol versions of rifles that are legal, they are technically illegal but no one seems to enforce it. Stores here still sell AR mages over 10 rounds.

So you my be playing with fire but at least if you purchase the magazine at a dealer in Hawaii you could at least have the defense of  saying that HPD has never enforced it and you bought it at a legal store in the event that HPD decides to enforce the law.

Exactly.

And even if HPD doesn't classify those mags as compatible with assault rifles, companies won't play around and take your word for it, because the state of Hawaii will hold them liable for sending illegal merchandise into the state.

A pump action gun is not an assault pistol. Look up the definition of assault pistol.

AR pistols are classified as assault pistols unless rendered to a configuration in which they are no longer classified as assault pistols; i.e. welding the magazine to the pistol.

Because assault pistols are illegal, AR and AK mags are not effected, as they cannot be used in a former assault pistol that has a welded magazine.

Assault pistol is irrelevant at this point. Any rifle magazine that can be placed in a pistol is limited to 10 rounds. It doesn't matter whether that pistol is an assault pistol or not. The argument was previously made that since assault pistols are illegal that no one can have an AR pistol and thus there is no pistol to put a high capacity rifle magazine on. There are however non assault pistol pistols that take rifle magazines thus, technically speaking, high capacity AR magazines are illegal. A pump action AR pistol is not an assault pistol because it is no longer semi-automatic.

Technically, most rifle mags on the market today will fit some sort of pistol. The way HRS is worded bans all types of magazines over 10rds.

A simple example would be the FN PS90, no pistol was ever manufactured. but these 50rd magazines will fit the AR57 pistol. The PS90 mags are illegal under HRS.

I was denied normal mags because my CC was a HI billing address, even though my FFL is in PA. go figure.   ???

So I emailed cz regarding the scorpion carbine and this is their response below... So since they classify it as being a rifle we can purchase the 20 mags direct from them whether or not the shop we purchase order the rifle from will only order the 10 rd mag.  Ok now I'm on the fence again about buying one....
